He stated that the attorney for Washington University saw no <br />problem with changing the deed restriction for the building to increase the parking allotment to <br />fifty spaces. <br /> <br />The Chairperson called on Al Goldman, Director of Planning to provide the staff report. Mr. <br />Goldman stated that Gail and Keith Kitsis have filed an application in behalf of Bonzai Express <br />of St. Louis, Inc. for a conditional use permit to authorize the use of the premises at 7353 <br />Forsyth as a carry-out restaurant. The applicant proposes a restaurant with carry-out service in <br />the space marked on the floor plan as "Tenant Space #3". The application contains no <br />information on proposed signing, thus it is assumed that signing will conform in all respects to <br />the requirements of the University City Sign Code. The raised planters with light standards and <br />the raised sidewalk platform with stairs shown in the public-right-of-way are not included in this <br />review. The proposed hours of operation start at 10:00 a.m. every day and close at 12:00 <br />midnight. Based on code requirements, an additional 14 parking spaces are required for the uses <br />now proposed for this building. Before approval can be given for this use, the property owner <br />should amend the deed restriction on this property to increase from 35 to 50 the number of <br />parking spaces available to the tenants, employees and patrons of 7351-59 Forsyth. The <br />application provides no information on outdoor trash containers for patrons, litter control, or <br />control of food cooking or baking odors. The application states that the operation will comply <br />with all applicable University City ordinances and rules. Based on the application, Mr. <br />Goldman finds that the proposed conditional use will meet the standards for approval as set out <br />in Zoning Code Section 34-65.4 if the conditional use is limited by the conditions recommended <br />below. Accordingly, Mr. Goldman recommends approval subject to the following conditions: <br />1) Signs on the premises shall conform in all respects with the provisions of the University City <br />Sign Code. 2) This permit does not authorize the raised platform, stairs, planters or lighting on <br />the public sidewalk as shown on the application drawings. 3) The hours of business operation <br />shall be limited to starting business no earlier than 10:00 a.m. on any day of the week, closing <br />by midnight on Sunday through Thursday nights and closing by 1:00 a.m. the following morning <br />on Friday and Saturday nights. 4) All delivery vehicles shall park at the rear of the building and <br />use the rear doors only. 5) The operator of the restaurant shall be responsible to insure daily <br />collection from the refuse container if not otherwise provided by the building owner. Refuse <br />collection shall occur no earlier than 7:00 a.m. 6) The operator of the restaurant shall regularly <br />police the site and the area adjacent to the restaurant to remove litter and debris. 7) Trash <br />containers for patron use shall be available on the premises at all times. 8) An exhaust system <br />shall be installed andlor other means shall be taken to prevent any food preparation odors or <br />cooking odors from being perceptible beyond the lot lines of the property on which the <br />restaurant is located. 9) An amended deed restriction shall be recorded which provides that the <br />tenants of 7351 through 7359 Forsyth and their respective employees and patrons shall have <br />access to and the use of a minimum of fifty (50) parking spaces. <br /> <br />Mr. Goldman stated that the following sentence should be deleted from proposed condition 5 in <br />his memo to the Plan Commission, "The building permit for tenant finish shall not be issued <br /> <br />m-9-28.p1c <br />
