Mr. Goldman explained that the deed restriction did not callout a specific area. <br /> <br />Ms. Peniston asked if the applicant would be having any truck deliveries to the restaurant. Mr. <br />Kitsis stated there would be supply deliveries approximately two to three times per week. <br /> <br />Ms. Ratner stated that the area of the parking lot closest to the building is usually full during <br />the time Firestone is open. Since the old Famous Barr building is supposed have retail shops <br />on the first floor, the parking problem will orily become worse. The traffic and parking <br />regulations have not been enforced in that area and she feels that they should be. <br /> <br />Mr. Solodar stated that the other restaurants in the building have been permitted to stay open <br />until midnight during the week and 1:00 a.m. on weekends. Restricting this unit to earlier hours <br />would be unfair competition. He prefers to have the hours of operation be consistent. Ms. <br />Ratner stated that she will vote against approval of the application unless the hours of operation <br />are changed to an earlier closing time. <br /> <br />The Plan Commission determined that the evidence presented to the Plan Commission supports <br />the conclusion that the proposed conditional use: a) Complies with all applicable provisions of <br />the Zoning Code; b) At the specific location will contribute to and promote the community <br />welfare or convenience; c) Will not cause substantial injury to the value of neighboring property; <br />d) Complies with the overall neighborhood development plan and existing zoning district <br />provisions; and e) Will provide, if applicable, off-street parking and loading areas in accordance <br />with the standards contained in the Zoning Code. Mr. Safe moved that the Plan Commission <br />recommend approval of the Conditional Use Permit subject to the following conditions: <br /> <br />1. Signs on the premises shall conform in all respects with the provisions of the University <br />City Sign Code. <br />2. This permit does not authorize the raised platform, stairs, planters or lighting on the <br />public sidewalk as shown on the application drawings. <br />3. The hours of business operation shall be limited to starting business no earlier than 10:00 <br />a.m. on any day of the week, closing by midnight on Sunday through Thursday nights <br />and closing by 1:00 a.m. the following morning on Friday and Saturday nights. <br />4. All delivery vehicles shall park at the rear of the building and use the rear doors only. <br />5. The operator of the restaurant shall be responsible to insure daily collection from the <br />refuse container if not otherwise provided by the building owner. Refuse collection shall <br />occur no earlier than 7:00 a.m. <br />6. The operator of the restaurant shall regularly police the site and the area adjacent to the <br />restaurant to remove litter and debris. <br />7. Trash containers for patron use shall be available on the premises at all times. <br />8. An exhaust system shall be installed andlor other means shall be taken to prevent any <br />food preparation odors or cooking odors from being perceptible beyond the lot lines of <br />the property on which the restaurant is located. <br /> <br />m-9-28.plc <br />
