An amended deed restriction shall be recorded which provides that the tenants of 7351 <br />through 7359 Forsyth and their respective employees and patrons shall have access to and <br />the use of a minimum of fifty (50) parking spaces. <br />10. This conditional use permit is limited to the operations in this unit only. <br /> <br />The motion was seconded by Mr. Solodar and passed by a vote of 6 to 1, with Mr. Marsh, Mr. <br />Foxworth, Mr. Kahn, Mr. Solodar, Ms. Peniston and Mr. Safe voting "aye" and Ms. Ratner <br />voting "nay." <br /> <br />Text Amendment of ~34-40.3(g), adding "Outdoor Parking Facility" as a conditional use <br />in the "P A" - Public Activity District <br /> <br />Chairperson Marsh announced that a hearing was scheduled to hear an application from the <br />School District of University City represented by Roger Cayce, Executive Director of Buildings, <br />Maintenance and Security and David Winslow, Plant Manager for a text amendment of ~34- <br />40.3(g) to add "Outdoor Parking Facility" as a conditional use in the "PA" - Public Activity <br />District. <br /> <br />The Chairperson noted the Commission's procedures and criteria for reviewing text amendments. <br />The Chairperson called upon the applicants. <br /> <br />Mr. Cayce stated that the School District of University City is planning to build an Early <br />Learning Center at the current site of the school bus parking facility on Kingsland. Therefore, <br />the parking area for the buses needs to be relocated. The School District has decided to move <br />the buses to an area behind the building on the Brittany Woods Middle School lot. Since an <br />outdoor bus parking facility is not a permitted use in the "P A" - Public Activity District, the <br />School District is asking to have the Zoning Code amended in order to have the use classified <br />as a conditional use in that district. Assuming that the amendment is passed they are also asking <br />for a conditional use permit to operate the use at that location for 24 buses. <br /> <br />The Chairperson called on Al Goldman, Director of Planning to provide the staff report. Mr. <br />Goldman stated that Mr. David Winslow, representing the School District of University City, <br />has filed an application for a text amendment to Zoning Code Section 34-40.3 to add "outdoor <br />parking facility" to the list of conditional uses. Mr. Goldman feels that the language of the <br />amendment is too broad and would permit abuses not considered to be compatible to the purpose <br />of the "P A" - Public Activity District. As Mr. Goldman understands the application, it is <br />intended to allow the use of property in the "P A" - Public Activity District to be used for school <br />bus parking. The "P A" District is intended to accommodate uses and groupings of uses that <br />have a distinctly public character and to encourage the retention of open space such as <br />cemeteries and recreational areas.
