.

.

9-28-94 Plan Commission Meeting Minutes Page 6

"Public buildings.. ..but not including repair yards or garages, storage or warehouses."

In Mr. Goldman's judgement the parking and storage of school buses is in conflict with the text
and is consistent with the purpose of the district. He recommends that the application for text
amendment not be approved.

Mr. Marsh stated that although he does not agree with the language of the text amendment, he
does recognize a need for the parking of buses. He suggested that the outcome might be
achieved by a variance.

Mr. Goldman recommended against that procedure because it would be a use variance. If the
City is going to permit this use it should do so without violating the spirit of the Zoning Code.
It is his opinion that this type of use is not compatible with the purpose of the Public Activity
District. If this type of use is permitted it should be limited to specifically those buses that
transport passengers to and from the principal building on the lot where the use is located.

Mr. Solodar stated that he is unhappy with eliminating any open space. He further stated that
the buses do not just serve the Brittany Woods Middle School but the whole district. He
suggests that a more appropriate spot would be behind the McKnight School.

Mr. Cayce stated that this spot is ideal because it is secluded behind the school and the golf
course.

Mr. Kahn stated that he feels this site is appropriate for this use but does not agree with the text
of the amendment.

Mr. Cayce stated that the application is not unreasonable because the schools need buses and
they do have to be parked somewhere.

Ms. Ratner feels that this use is appropriate for a variance instead a zoning amendment.

Mr. Foxworth asked how many buses will be parked on the lot. Mr. Cayce replied 24. Mr.
Foxworth asked if the driveway would be widened to accommodate the bus use. Mr. Cayce
stated that they will be making improvements to the access road but will not be widening it.

Mr. Schoomer asked how many people will be working from the site and what extra security
will be provided for the buses. Mr. Cayce replied that there will be 20 drivers and then the lot
manager and his staff. The area will be fenced. Mr. Schoomer stated that he is concerned with
vandalism of the buses.

Mr. Marsh stated that he is in favor of the buses at this site but feels the text amendment to
allow it needs to be narrowly tailored.

m-9-28.plc
