<br />. <br /> <br />. <br /> <br />9-28-94 Plan Commission Meeting Minutes Page 8 <br /> <br />not cause substantial injury to the value of neighboring property; d) complies with the overall <br />neighborhood development plan and existing zoning district provisions; and e) will provide, if <br />applicable, off-street parking and loading areas in accordance with the standards contained in the <br />Zoning Code. <br /> <br />Ms. Ratner stated that in light of the Plan Commission's vote for denial of the text amendment <br />that would allow the use, she suggests that the Plan Commission table this application to allow <br />the applicant a chance to come up with alternative language for the text amendment. Ms. Ratner <br />moved that the application be tabled until the October meeting. The motion was seconded by <br />Mr. Kahn and passed by vote of 7 to 0 with all members voting "aye." <br /> <br />Public Hearing: Conditional Use Permit #323, conversion of two-family dwelling into one- <br />family dwelling in "MR" - Medium Density Residential District, 8015 Delmar <br /> <br />Chairperson Marsh announced that a public hearing was scheduled to hear an application from <br />Yale and Gail Miller for a Conditional Use Permit in order to allow the premises at 8015 <br />Delmar to be converted from a two-family dwelling to a one-family dwelling. <br /> <br />The Chairperson noted the Commission's procedures and criteria for reviewing conditional use <br />permits and amendments to them. He specifically stated that the Plan Commission must consider <br />whether the use: a) complies with all applicable provisions of the Zoning Code; b) at the <br />specific location will contribute to and promote the community welfare or convenience; c) will <br />not cause substantial injury to the value of neighboring property; d) complies with the overall <br />neighborhood development plan and existing zoning district provisions; and e) will provide, if <br />applicable, off-street parking and loading areas in accordance with the standards contained in the <br />Zoning Code. The Chairperson called upon the applicant. <br /> <br />Yale Miller, 7909 Cornell, stated that he wishes to convert a two-family dwelling located at <br />8015 Delmar, to a single family home. Mr. Miller gave an overview of his application. <br /> <br />The Chairperson called on Al Goldman, Director of Planning to provide the staff report. Mr. <br />Goldman stated that the conversion of the existing two-family dwelling to a single-family <br />dwelling located in the "MR" - Medium Density Residential District requires a conditional use <br />permit. His review of the application indicates the proposed single family dwelling will meet <br />all zoning district requirements, will have a positive effect on community welfare and <br />convenience, will not injure the value of neighboring property, is not inconsistent with <br />neighborhood development plans and zoning district provisions, and provides off street parking <br />in accordance with the Zoning Code. Accordingly, He recommends approval based on a finding <br />that the proposed conditional use will meet all of the standards of Section 34-65.4 of the Zoning <br />Code. <br /> <br />The Chairperson opened the public hearing and asked for testimony from the public.
