He specifically stated that the Plan Commission must consider
whether the use: a) complies with all applicable provisions of the Zoning Code; b) at the
specific location will contribute to and promote the community welfare or convenience; c) will
not cause substantial injury to the value of neighboring property; d) complies with the overall
neighborhood development plan and existing zoning district provisions; and e) will provide, if
applicable, off-street parking and loading areas in accordance with the standards contained in the
Zoning Code. The Chairperson called upon the applicant.

Yale Miller, 7909 Cornell, stated that he wishes to convert a two-family dwelling located at
8015 Delmar, to a single family home. Mr. Miller gave an overview of his application.

The Chairperson called on Al Goldman, Director of Planning to provide the staff report. Mr.
Goldman stated that the conversion of the existing two-family dwelling to a single-family
dwelling located in the "MR" - Medium Density Residential District requires a conditional use
permit. His review of the application indicates the proposed single family dwelling will meet
all zoning district requirements, will have a positive effect on community welfare and
convenience, will not injure the value of neighboring property, is not inconsistent with
neighborhood development plans and zoning district provisions, and provides off street parking
in accordance with the Zoning Code. Accordingly, He recommends approval based on a finding
that the proposed conditional use will meet all of the standards of Section 34-65.4 of the Zoning
Code.

The Chairperson opened the public hearing and asked for testimony from the public.
