There will be <br />outdoor storage of the storage containers but they will be empty except for rare occasions when <br />it will be too late to take the containers to the dump. The waste is from construction sites and <br />will not contain biodegradable waste such as garbage. <br /> <br />The Chairperson called on Al Goldman, Director of Planning to provide the staff report. Mr. <br />Goldman stated that the proposed building and the proposed use will not result in high quality <br />development and will do little to project a positive community image. However it complies with <br />the neighborhood development plan, can be made to comply with the provisions of the Zoning <br />Code, and will not injure the value of neighboring property. In fact the removal of the derelict <br />building from the site in order to make way for the proposed development clearly improved the <br />value of neighboring property and promotes the community welfare. Mr. Goldman addressed <br />the issues of screening, landscaping, signs, building design and mechanical equipment and gave <br />his recommendations as stated in his memo submitted for this application. <br /> <br />The Chairperson opened the public hearing and asked for testimony from the public. Sam <br />Wilson of American Water Treatment voiced concerns about the waste but said he was satisfied <br />that it was construction waste. Jim McDerby of Weskem Hall, 6300 Bartmer stated that he also <br />was concerned about the waste but said he was satisfied that it was construction waste. No other <br />members of the public indicated a desire to speak, so the public hearing portion of the meeting <br />was closed. <br /> <br />Mr. Solodar suggested that a cross-easement be obtained to take care of concerns over the access <br />to properties. Mr. Wilson stated that would be o.k. Mr. Solodar suggested that a condition be <br />added that will prohibit storage of rapidly biodegradable waste. <br /> <br />That Plan Commission decided that if the property was to be increased in size by the acquisition <br />of extra land that the applicant would not have to come before the Commission to amend the <br />conditional use permit. <br /> <br />The Plan Commission determined that the evidence presented to the Plan Commission supports <br />the conclusion that the proposed conditional use: a) Complies with all applicable provisions of <br />the Zoning Code; b) At the specific location will contribute to and promote the community <br />welfare or convenience; c) Will not cause substantial injury to the value of neighboring property; <br />d) Complies with the overall neighborhood development plan and existing zoning district <br />provisions; and e) Will provide, if applicable, off-street parking and loading areas in accordance <br />with the standards contained in the Zoning Code. Mr. Solodar moved that the Plan Commission <br />recommend approval of the Conditional Use Permit subject to the following conditions: <br /> <br />m-l0-26.plc <br />
