Mr. Segall stated that he only uses his part of the building <br />between 8 a.m. and 2 p.m. Saturday and between Midnight and 6:30 a.m. on Sunday. They do <br />not anticipate any overlap. <br /> <br />Ms. Peniston stated that she hopes the church will clean up the area between the church and the <br />use to the west which might encourage the use to the west to clean their lot. Mr. Femmer and <br />Mr. Segall stated that they will. <br /> <br />Mr. Hill suggested that deadlines for turning in the landscaping plan and for landscaping <br />installation be added to condition 4. Mr. Femmer agreed to having the landscaping plan to Mr. <br />Goldman by April 1, 1995 and having the landscaping installed by no later than November 1, <br />1995. <br /> <br />The Plan Commission determined that the evidence presented to the Plan Commission supports <br />the conclusion that the proposed conditional use amendment: a) Complies with all applicable <br />provisions of the Zoning Code; b) At the specific location will contribute to and promote the <br />community welfare or convenience; c) Will not cause substantial injury to the value of <br />neighboring property; d) Complies with the overall neighborhood development plan and existing <br />zoning district provisions; and e) Will provide, if applicable, off-street parking and loading areas <br />in accordance with the standards contained in the Zoning Code. Mr. Marsh moved that the Plan <br />Commission recommend approval of the Conditional Use Permit Amendment subject to the <br />following condition: <br /> <br />1. The parking lot shall retain the current parking stall layout but shall include at least 3 <br />spaces designed for handicapped access. <br />2. The occupancy of the church shall be limited to a maximum of 160 adults at any time. <br />3. The space in the north wing which is not shown on the tloor plan shall be limited to <br />storage and office use with no more than 2 persons on the premises in connection with <br />this use when the church is in use for religious services, adult education or assembly <br />uses. <br />4. A detailed landscaping plan shall be submitted to the Director of Planning no later than <br />April 1, 1995 for his review and approval. The plan shall include tree planting in the <br />parking lot islands and in the transitional yard along the north side of the parking lot. <br />All landscaping shall be installed no later than November I, 1995 and shall be maintained <br />in accordance with the approved plan. <br />5. Refuse containers shall be stored north of the north wing of the building. <br />6. Signs shall be installed and maintained in strict compliance with the provisions of the <br />University City Sign Code. <br />7. There shall be no change in ownership status that includes purchase by a person, <br />association, corporation, institution or foundation that has been designated as exempt <br />from payment of any tax levied by the city unless the change in status is first reviewed <br />and authorized by the City Council under the Site Plan Review process. <br /> <br />1ll-2-22,plc <br />
