Mr. Segall stated that he only uses his part of the building between 8 a.m. and 2 p.m. Saturday and between Midnight and 6:30 a.m. on Sunday. They do not anticipate any overlap. Ms. Peniston stated that she hopes the church will clean up the area between the church and the use to the west which might encourage the use to the west to clean their lot. Mr. Femmer and Mr. Segall stated that they will. Mr. Hill suggested that deadlines for turning in the landscaping plan and for landscaping installation be added to condition 4. Mr. Femmer agreed to having the landscaping plan to Mr. Goldman by April 1, 1995 and having the landscaping installed by no later than November 1, 1995. The Plan Commission determined that the evidence presented to the Plan Commission supports the conclusion that the proposed conditional use amendment: a) Complies with all applicable provisions of the Zoning Code; b) At the specific location will contribute to and promote the community welfare or convenience; c) Will not cause substantial injury to the value of neighboring property; d) Complies with the overall neighborhood development plan and existing zoning district provisions; and e) Will provide, if applicable, off-street parking and loading areas in accordance with the standards contained in the Zoning Code. Mr. Marsh moved that the Plan Commission recommend approval of the Conditional Use Permit Amendment subject to the following condition: 1. The parking lot shall retain the current parking stall layout but shall include at least 3 spaces designed for handicapped access. 2. The occupancy of the church shall be limited to a maximum of 160 adults at any time. 3. The space in the north wing which is not shown on the tloor plan shall be limited to storage and office use with no more than 2 persons on the premises in connection with this use when the church is in use for religious services, adult education or assembly uses. 4. A detailed landscaping plan shall be submitted to the Director of Planning no later than April 1, 1995 for his review and approval. The plan shall include tree planting in the parking lot islands and in the transitional yard along the north side of the parking lot. All landscaping shall be installed no later than November I, 1995 and shall be maintained in accordance with the approved plan. 5. Refuse containers shall be stored north of the north wing of the building. 6. Signs shall be installed and maintained in strict compliance with the provisions of the University City Sign Code. 7. There shall be no change in ownership status that includes purchase by a person, association, corporation, institution or foundation that has been designated as exempt from payment of any tax levied by the city unless the change in status is first reviewed and authorized by the City Council under the Site Plan Review process. 1ll-2-22,plc
