Mr. <br />Goldman stated that a Conditional Use Permit was issued June 27, 1977 for a carry out <br />restaurant at this location. The facility ceased operations over 12 months ago and thus a new <br />conditional use permit is required before operations are resumed. The current application shows <br />the same floor plan as the former operation. This facility has served the community convenience <br />for a period of over 16 years without negatively impacting the health, safety or welfare of the <br />public or injuring the value of other property in the neighborhood. He recommends approval <br />of the application subject to the following conditions in order to insure compliance with the <br />standards of Section 34-65.4 of the Zoning Code: 1) Primary signage shall be limited to a single <br />wall sign mounted above the display window and not exceeding 25 square feet in gross sign <br />area. 2) A detailed landscaping plan shall be submitted to the Director of Planning for his <br />review and approval. Landscaping shall be installed and maintained in accordance with the <br />approved plan. 3) Adequate refuse disposal shall be provided by and for the business. Outdoor <br />storage of refuse containers shall be as approved by the Director of Planning. 4) An exhaust <br />system shall be installed and maintained or other means shall be taken to prevent food <br />preparation odors or cooking odors from being readily perceptible beyond the lot lines of the <br />property on which the restaurant is located. 5) Hours of operation shall be limited daily to the <br />hours between 10:00 a.m. and 11:00 p.m. <br /> <br />Chairperson Ratner opened the public hearing and asked for testimony from the public. Louis <br />Hall, 1526 Faris, stated that she is the owner of the building and runs the beauty shop next door <br />to the proposed restaurant location. She is in full support of the proposal. She thinks it will be <br />beneficial to her, her customers and the general public. No other members of the public <br />indicated a desire to speak, so the public hearing portion of the meeting was closed. <br /> <br />Ms. Harris asked that the hours of operation be extended until 1:00 a.m. Saturday evening <br />(Sunday morning). She stated that a major portion of her income will come in on Saturday <br />evenings. Mr. Solodar stated that the 1 :00 a. m. closing time only for Saturdays does not bother <br />him. Mr. Kahn agreed. <br /> <br />Ms. Ratner asked if the restaurant would have delivery service. Ms. Harris stated that it would <br />not. It will be mainly carry out. Ms. Ratner stated that she would like a condition added that <br />would require the applicant to patrol for litter. She further stated that she would like the first <br />condition to be changed to limit the signage to only that which is approved under the Sign Code. <br /> <br />Mr. Kahn stated that there has already been a restaurant in that location which proved beneficial <br />to the community. There was also discussion relating to adequacy of parking and it was <br />determined that at the present time no problem would result because other shops are not rented; <br />this needs to be considered when other tenants are added. <br /> <br />The Plan Commission determined that the evidence presented to the Plan Commission supports <br />the conclusion that the proposed conditional use amendment: a) Complies with all applicable <br /> <br />m-8-23.plc <br />
