This applicant wishes to obtain approval for a carry out restaurant but in the unit designated <br />as 6841 Olive. A separate conditional use permit is required. The current application shows a floor <br />plan similar to those formerly approved. The previous restaurant served the community convenience <br />for a period of over 16 years without negatively impacting the health, safety or welfare of the public <br />or injuring the value of other property in the neighborhood. There is adequate parking for the <br />restaurant at this time. The impact on parking for future tenants in other units shall be reviewed <br />separately when those applications are made. He recommends approval of the application subject to <br />the following conditions in order to insure compliance with the standards of Section 34-65.4 of the <br />Zoning Code: 1) Primary signage shall be limited to a single wall sign mounted above the display <br />window and not exceeding 25 square feet in gross sign area. 2) A detailed landscaping plan shall be <br />submitted to the Director of Planning for his review and approval. Landscaping shall be installed and <br />maintained in accordance with the approved plan. 3) Adequate refuse disposal shall be provided by <br />and for the business. Outdoor storage of refuse containers shall be as approved by the Director of <br />Planning. 4) An exhaust system shall be installed and maintained or other means shall be taken to <br />prevent food preparation odors or cooking odors from being readily perceptible beyond the lot lines <br />of the property on which the restaurant is located. 5) Hours of operation shall be limited daily to the <br />hours between 10:00 a.m. and 11:30 p.m. <br />Ms. Martin asked that condition 5 be changed to: Hours of operation shall be limited to the hours <br />between 9:00 a.m. and 11:30 p.m., except on Fridays and Saturdays the hours of operation shall be <br />limited to the hours between 9:00 a.m. and 1:30 a.m. the next morning. <br />Chairperson Solodar opened the public hearing and asked for testimony from the public. Louise Hall, <br />1526 Faris, St. Louis, Missouri 63133 stated that she owns the property in question. She needs <br />clarification on why landscaping is required in condition 2. Mr. Goldman replied that there will be <br />a requirement that additional landscaping be added to the site under a plan to be brought about by <br />the applicant and the owner of the property and approved by him. She stated that she would abide <br />by that. Ms. Hall stated that she was concerned about the parking for other tenants. Mr. Hill replied <br />that the lot currently has enough parking for the current tenants. As other tenants move in the <br />parking needs will be reevaluated. No other members of the public indicated a desire to speak, so <br />the public hearing portion of the meeting was closed. <br />Ms. Ratner stated she wants the following condition added: The operator of the restaurant shall <br />regularly police the site and the area adjacent to the restaurant to remove litter and debris. <br />The Plan Commission determined that the evidence presented to the Plan Commission supports the <br />conclusion that the proposed conditional use: a) Complies with all applicable provisions of the <br />Zoning Code; b) At the specific location will contribute to and promote the community welfare or <br />convenience; c) Will not cause substantial injury to the value of neighboring property; d) Complies <br />with the overall neighborhood development plan and existing zoning district provisions; and e) Will <br />provide, if applicable, off-street parking and loading areas in accordance with the standards contained <br />m-3-27.plc <br /> <br />
