June 26, 1996 Plan Commission Meeting Minutes Page 3 <br />Mr. Foxworth asked if the parking spaces on the east side of the building would be angled. Mr. Mak <br />? <br />said the they would be 90 parking spaces. <br />Ms. Peniston asked what type and size of freestanding sign is permitted under the Sign Code for this <br />location. Mr. Goldman stated that they would be permitted one freestanding sign, not over 10' in <br />height. However, that would be inconsistent with the tree planting required along Olive. Perhaps <br />a monument type freestanding sign would work if it was located on the east side of the property. Mr. <br />Yeung agreed to that. <br />Mr. Price asked if there would be cooking exhaust problems. Mr. Goldman replied that proposed <br />condition #3 covered that situation. <br />Mr. Kahn asked whether the carry-out hours would be the same as the store hours. Mr. Fung stated <br />that they would be. <br />Ms. Peniston stated that she would like to change proposed condition #1 to allow a freestanding <br />monument sign if it is located on the east side of the property. <br />The Plan Commission determined that the evidence presented to the Plan Commission supports the <br />conclusion that the proposed conditional use: a) Complies with all applicable provisions of the <br />Zoning Code; b) At the specific location will contribute to and promote the community welfare or <br />convenience; c) Will not cause substantial injury to the value of neighboring property; d) Complies <br />with the overall neighborhood development plan and existing zoning district provisions; and e) Will <br />provide, if applicable, off-street parking and loading areas in accordance with the standards contained <br />in the Zoning Code. Ms. Peniston moved that the Plan Commission recommend approval of the <br />Conditional Use Permit subject to the following conditions: <br />1.The signage shall strictly comply with the provisions of the University City Sign Code, except <br />that freestanding signs shall be limited to a low "monument" sign in the planting area at the <br />southeast corner of the site. <br />2.A detailed landscaping plan shall be submitted to the Director of Planning for his review and <br />approval. The plan shall include two large planting areas with a tree in each. Landscaping <br />shall be installed and maintained in accordance with the approved plan. <br />3.An exhaust system shall be installed and maintained or other means shall be taken to prevent <br />food preparation odors or cooking odors from being readily perceptible beyond the lot lines <br />of the property on which the restaurant is located. <br />4.The operator of the restaurant shall regularly police the site and the area adjacent to the <br />restaurant to remove litter and debris. <br />5.The parking area shall be repaved and parking stalls marked per a revised site plan that <br />provides two planting areas with portland cement curbs. The revised site plan shall be <br />submitted to the Director of Planning for review and approval. <br />6.Dine-in facilities shall not be provided and the carry-out portion of the business shall not be <br />m-6-26.plc <br /> <br />
