"Lot 1" should be labeled on the plat as "Remainder of Lot 1" to clarify that it is not the <br />entire lot as originally recorded in Block E of Delmar Garden. 2) Ordinance No. 4216 that vacates <br />a portion of Delmar Boulevard reserves the right of the City to maintain utilities and a public sidewalk <br />in the vacated property. Thus the plat should indicate an easement to the City for utilities and a <br />public sidewalk. 3) Ordinance No. 5566 that vacates a portion of Syracuse Ave. reserves the public <br />utility easements. An easement should indicated on the plat for the water main that runs close to the <br />west side of the former Syracuse Avenue. 4) The portion of Syracuse Avenue that is shown vacated <br />by "Ordinance No. 4462" should be corrected to read "Ordinance No. 4468". 5) Since all of the <br />vacated portions of Enright and Syracuse Avenues were vacated subject to public utility easements, <br />the plat should indicate the utility easements. If any of the easements have been vacated by the utility <br />companies, a copy of the recorded easement vacation documents should be delivered to the City and <br />approved by the City Attorney before the final plat is signed by the City Clerk. <br />Mr. Best submitted copies of a revised plat, prepared in response to Mr. Goldman's comments. <br />Chairperson Solodar asked if any members of the public wished to comment. No members of the <br />public indicated a desire to speak. <br />Mr. Walsh asked if the changes in the property line would allow any decrease in the public safety. <br />Mr. Goldman replied that there would not be any decrease in safety, it allows Louis London to <br />construct the bridge between their new building and their current building and to comply with the <br />building code. <br />Mr. Price moved that the Plan Commission approve the resubdivision of 6677 Delmar, Lots 2, 3 and <br />Part of Lot 1 of Delmar Garden subject to the following items being satisfactorily addressed prior to <br />approval from the City Council: <br />1.The east lot line of Parcel B does not coincide with the west property line of Lot 1. It <br />appears that part of Lot 1 was conveyed to the owner of Lot 2. This conveyance should be <br />tied down by dimension and the Recorder of Deeds book and page should be shown.
