December 11, 1996 Plan Commission Minutes Page 4 <br />Mr. Lieberman asked if the children come from all around the county. Ms. Buckley replied that the <br />children come from all over the city, the county, St. Charles and one child commutes from Ste. <br />Genevieve. <br />Mr. Foxworth asked who refers the children to the school. Ms. Buckley replied school counselors, <br />psychologists, psychiatrists and word of mouth. <br />Mr. Lieberman asked if the staff is certified. Ms. Buckley replied that all of the staff is certified by <br />the State of Missouri. The school is accredited through the North Central Association and ISACS. <br />Mr. Solodar asked if the children would be permitted to smoke on campus. Ms. Buckley replied that <br />they would not. Mr. Solodar stated that if the application is approved he would like to add a <br />condition that states: External security lighting that abuts residential areas shall be located along the <br />perimeter of the property facing inward and shall shielded from casting light upon abutting residential <br />property. He stated that he is concerned that the parking may be insufficient for this use even though <br />it meets code requirements. <br />Mr. Foxworth stated that he would like the term "acceptable to both parties" added to proposed <br />condition #5. <br />The Plan Commission determined that the evidence presented to the Plan Commission supports the <br />conclusion that the proposed conditional use: a) Complies with all applicable provisions of the <br />Zoning Code; b) At the specific location will contribute to and promote the community welfare or <br />convenience; c) Will not cause substantial injury to the value of neighboring property; d) Complies <br />with the overall neighborhood development plan and existing zoning district provisions; and e) Will <br />provide, if applicable, off-street parking and loading areas in accordance with the standards contained <br />in the Zoning Code. <br />Mr. Foxworth moved that the Plan Commission recommend approval of the Conditional Use Permit <br />subject to the following conditions: <br />1.A revised site plan showing the off-street parking, service area pavement and curbs, refuse <br />storage boxes, outdoor play area paving and equipment, and fencing shall be submitted to the <br />Director of Planning for review and approval. All improvements shall be installed prior to the <br />issuance of an occupancy permit. <br />2.A 30 foot wide transitional yard shall be provided along all portions of the site abutting <br />residential lots. Where the location of the existing building prevents creating a 30 foot wide <br />transitional yard, the yard width shall be equal to the space between the building and the <br />property line, and between the service drive and the property line. All parts of the transitional <br />yard shall be densely planted with a combination of evergreen and deciduous trees, and the <br />entire perimeter of the transitional yard shall be fenced with a privacy fence at least 6' in <br />m-12-11.plc <br /> <br />
