Mr. Hill reviewed his memo. <br />Ms. Peniston moved that the final plat for the Consolidated Lot 15 of Block 2 of New Delmar <br />Heights located at 501, 509 and 515 North & South be recommended for approval. The motion was <br />seconded by Ms. Glassman and passed by a vote of 6 to 0 with all members voting "aye." <br />It was noted that City Council will need to approve an easement vacation on this matter, that is not <br />reviewed received by the Plan Commission. <br />Text Amendments: 34-40.1; 34-40.6; 34-40.7(4)(b); 34-40.16(2)(b); 34-62.1(7) and (8); 34-94.2; <br />and 34-162.4. [also 34-40.7(1)(e) and 34-40.7(3)(h)] <br />Chairperson Solodar announced that a hearing was scheduled to consider an application from City <br />Council Person, Robert Wagner for text amendment of various zoning code sections. <br />Mr. Wagner gave an overview of his proposed changes. He stated that his goal was to protect the <br />sensitivity to existing neighborhoods. <br />Mr. Ollendorff stated that the proposed amendments to 34-40.7(1)(e) and 34-40.7(3)(h) may violate <br />the requirements of the Comprehensive Plan and suggested delaying the discussion on those until <br />after the revision of the plan is started. <br />Each proposed text amendment follows with the commission’s decision on the amendment <br />immediately preceding (additions are bolded, deletions are stricken out). <br />34-40.1 Intent and Purpose <br />The purpose of the Planned Development Districts is to provide a means of achieving greater <br />flexibility in development of land in a manner not always possible in conventional zoning districts; <br />to encourage a more imaginative and innovative design of projects; to promote a more desirable <br />community environment; and to retain maximum control over both the design and future operation <br />of the development. <br />The City Council, upon review by the Plan Commission, may, by an ordinance adopted in the same <br />manner as a rezoning is approved, authorize a Planned Development district when the proposed <br />development or use of a specific tract of land or area warrants greater flexibility, control and density <br />than is afforded under the general regulations of standard zoning districts. These Planned <br />Development regulations are not intended to allow excessive densities, or the development of <br />incompatible land uses, either within the development, or as the development relates to the general <br />especially including abutting residential neighborhood <br />neighborhood .
