He specifically stated that the Plan Commission must consider <br />whether the use: a) complies with all applicable provisions of the Zoning Code; b) at the specific <br />location will contribute to and promote the community welfare or convenience; c) will not cause <br />substantial injury to the value of neighboring property; and d) is consistent with the Comprehensive <br />Plan, neighborhood development plan (if applicable), and any other official planning and <br />development policies of the City; and e) will provide off-street parking and loading areas in <br />accordance with the standards contained in Article 7 of the Zoning Code. The Chairperson called <br />upon the applicant. <br />Mr. Baron and Mr. Leonard gave an overview of the project. They highlighted that the proposal will <br />be close to the same elevation as the surrounding homes in the area. They summarized that the <br />project meets all of the criteria set forth in the zoning code except for the common open space <br />requirement. <br />Chairperson Solodar called on Frank B. Hill, Zoning Administrator to provide the staff report. Mr. <br />Hill summarized the Planning Department Staff Report dated February 20, 1998 which is <br />incorporated into these minutes by reference. He stated that the staff recommends approval of the <br />application subject to the following conditions: 1) The approval of this application shall be <br />contingent upon the full project area being rezoned to be included in the “HRO” - High Density <br />Residential/Office District. 2) Common open space shall be provided in accordance with zoning <br />requirements as may be amended. 3) The development shall be constructed and maintained in <br />compliance with the plans submitted for this conditional use permit review. 4) All employee and <br />special event parking for the facility shall be on-site and shall be specifically excluded from the <br />public streets. 5) Operation of the convenience and retail uses shall comply with the requirements <br />of section 34-34.4 of the zoning code. 6) The parking lot shall be designed and constructed in <br />accordance with the regulations set forth in the construction requirements of 34-92.1, the vehicular <br />access and circulation requirements of 34-92.2 and the Handicap Parking requirements of 34-93.2. <br />7) Lighting of the parking areas shall comply with the requirements of section 34-93.7 of the zoning <br />code. Lighting shall be designed to be compatible with surrounding residential uses. 8) City council <br />shall grant the allowable 20% reduction in the boundary requirement of section 34-57.3(1) as <br />permitted in section 34-131.3. 9) A detailed landscaping plan shall be submitted to the Director of <br />Planning for her/his review and approval. Landscaping shall be installed and maintained in <br />accordance with the approved plan. 10) All conditions of the previous Conditional Use Permit #241 <br />and amendments to CUP #241(A) are incorporate herein. 11) Drainage must be approved by MSD <br />and/or the University City Public Works Department. 12) Exhaust control for kitchen, laundry and <br />other facilities shall be installed or maintained in order to prevent smoke and odors from being <br />perceptible beyond the property lines of the development. <br />Chairperson Solodar opened the public hearing and asked for testimony from the public. Daniel <br />Talonn, 8661 Barby stated that the mixed uses inside the building are not just for the residents. <br />There is totally inadequate parking for the facility. G. G.
