May 26, 1999 Plan Commission Minutes Page 2 of 3 Ms. Peniston moved that the Plan Commission approve the final plat for the 7398 Norwood Condominiums. The motion was seconded by Ms. Glassman and passed by a vote of 6 to 0, with all members voting “aye.” Hearing: Street Dedication, Delcrest Court Chairperson Solodar announced that a hearing was scheduled to hear a street dedication application from the Delcrest Court Condominium Association, 5 Delcrest Drive, University City, MO 63124. The applicant has presented a final plat and wishes to dedicate the street to the City. The Chairperson noted the Commission's procedures and criteria for street dedication applications. Mr. Hill gave the staff recommendation that the application be approved per his memo dated May 22, 1999. Ms. Glassman moved that the Plan Commission approve the final plat for the Delcrest Court Street Dedication. The motion was seconded by Ms. Ms. Peniston and passed by a vote of 6 to 0, with all members voting “aye.” Public Hearing: Conditional Use Permit Amendment #285(A), Convenience Store / Gasoline Station, 8341 Olive Chairperson Solodar announced that a public hearing was scheduled to hear an application from Y’s Choice, LLC c/o Darryl Wikoff, Manger, 724 Spirit 40 Park Drive, Chesterfield, MO 63005. The applicant requests a Conditional Use Permit Amendment in order to redesign the convenience store building and modify the rear setback per Section 34-36.5(2)(c) of the University City Zoning Code for the convenience store / gasoline station use. The Chairperson noted the Commission's procedures and criteria for reviewing conditional use permits and amendments to them. The Chairperson specifically stated that the Plan Commission must consider whether the use: a) Complies with all applicable provisions of the University City Zoning Code; b) At the specific location will contribute to and promote the community welfare or convenience; c) Will not cause substantial injury to the value of neighboring property; d) Is consistent with the Comprehensive Plan, neighborhood development plan (if applicable), and any other official planning and development policies of the City; and e) Will provide off-street parking and loading areas in accordance with the standards contained in Article 7 of the University City Zoning Code. wpoffice\wpdata\m-5-26.plc
