October 27, 1999 Plan Commission Minutes Page 3 of 5 <br />Mr. Smith moved that the Plan Commission approve the final plat. The motion was seconded by <br />Ms. Glassman and passed by a vote of 5 to 0, with all members voting “aye” (Mr. Price was not <br />present for the vote on this agenda item). <br />Public Hearing: Conditional Use Permit #352, Real Estate Office Associated with <br />Residential Development, 530 North & South <br />Chairperson Solodar announced that a public hearing was scheduled to hear an application from <br />Fischer & Frichtel, represented by Robert Howe, #7 Pines Ct., St. Louis, MO 63130. The <br />applicant requests a Conditional Use Permit in order to operate a real estate office associated <br />with a residential development. <br />The Chairperson noted the Commission's procedures and criteria for reviewing conditional use <br />permits and amendments to them. The Chairperson specifically stated that the Plan Commission <br />must consider whether the use: a) Complies with all applicable provisions of the University City <br />Zoning Code; b) At the specific location will contribute to and promote the community welfare <br />or convenience; c) Will not cause substantial injury to the value of neighboring property; d) Is <br />consistent with the Comprehensive Plan, neighborhood development plan (if applicable), and any <br />other official planning and development policies of the City; and e) Will provide off-street <br />parking and loading areas in accordance with the standards contained in Article 7 of the <br />University City Zoning Code. <br />Robert Howe gave an overview of the proposal. <br />Mr. Walker gave the staff recommendation that the application be approved per the October 20, <br />1999 Staff Memo. <br />Chairperson Solodar opened the public hearing and asked for testimony from the public. Bruce <br />Rennekamp, 527 Central, asked for clarification that the units would be condominiums and not <br />rental units. Mr. Howe verified that the units would be condominiums. Marian Flowers, 539 <br />Central asked for a construction time frame. Mr. Howe stated that the first building should be <br />finished by August of 2000. No other members of the public indicated a desire to speak, so the <br />public hearing portion of the meeting was closed. <br />The Plan Commission determined that the evidence presented to the Plan Commission does <br />support the conclusion that the proposed conditional use amendment: a) Complies with all <br />applicable provisions of the University City Zoning Code; b) At the specific location will <br />contribute to and promote the community welfare or convenience; c) Will not cause substantial <br />injury to the value of neighboring property; d) Is consistent with the Comprehensive Plan, <br />neighborhood development plan (if applicable), and any other official planning and development <br />policies of the City; and e) Will provide off-street parking and loading areas in accordance with <br />the standards contained in Article 7 of the University City Zoning Code.
