February 29, 1999 Plan Commission Minutes Page 2 of 4 <br />consistent with the Comprehensive Plan, neighborhood development plan (if applicable), and any <br />other official planning and development policies of the City; and e) Will provide off-street <br />parking and loading areas in accordance with the standards contained in Article 7 of the <br />University City Zoning Code. <br />Chad Matthews, St. Louis Smoothie Manager, gave an overview requesting that the hours of <br />operation be extended to those between 6:00 a.m. and 12:00 a.m. and that interior tables be <br />permitted per the site plan submitted with the application. He asked that the application be <br />approved. He also stated that the applicant agrees to the conditions as set forth in the staff <br />recommendation. <br />Mr. Hill gave the staff recommendation that the application be approved per his February 14, <br />2000 memo. <br />Chairperson Solodar opened the public hearing and asked for testimony from the public. No <br />members of the public indicated a desire to speak, so the public hearing portion of the meeting <br />was closed. <br />The Plan Commission determined that the evidence presented to the Plan Commission does <br />support the conclusion that the proposed conditional use amendment: a) Complies with all <br />applicable provisions of the University City Zoning Code; b) At the specific location will <br />contribute to and promote the community welfare or convenience; c) Will not cause substantial <br />injury to the value of neighboring property; d) Is consistent with the Comprehensive Plan, <br />neighborhood development plan (if applicable), and any other official planning and development <br />policies of the City; and e) Will provide off-street parking and loading areas in accordance with <br />the standards contained in Article 7 of the University City Zoning Code. Ms. Glassman moved <br />that the Plan Commission recommend approval of the Conditional Use Permit Amendment with <br />the following conditions: <br />1.The outdoor seating area shall be maintained in good condition at all times. Chairs and <br />tables shall not be stored outdoors during seasons when the area is not in use. <br />2.Signs on the premises shall conform in all respects with the provisions of the University <br />City Sign Code. <br />3. The operator of the restaurant shall regularly police the site and the area adjacent to the <br />restaurant to remove litter and debris. <br />4. Trash containers for patron use shall be available on the premises at all times. Adequate <br />refuse disposal shall be provided by and for the business.
