July 19, 2000 Plan Commission Minutes Page 2 of 7 <br />The Chairperson noted the Commission's procedures and criteria for reviewing conditional use <br />permits and amendments to them. The Chairperson specifically stated that the Plan Commission <br />must consider whether the use: a) Complies with all applicable provisions of the University City <br />Zoning Code; b) At the specific location will contribute to and promote the community welfare <br />or convenience; c) Will not cause substantial injury to the value of neighboring property; d) Is <br />consistent with the Comprehensive Plan, neighborhood development plan (if applicable), and any <br />other official planning and development policies of the City; and e) Will provide off-street <br />parking and loading areas in accordance with the standards contained in Article 7 of the <br />University City Zoning Code. <br />Mr. Hill gave the staff recommendation that the application be approved per the July 13, 2000 <br />Staff Report. <br />Mubeen Mahmood, applicant, gave an overview of the changes in the canopy plan and stated that <br />he would like to open for the following hours: between 6 a.m. and 11 p.m. Sunday through <br />Thursday and to those between 6 a.m. and 12 a.m. Friday and Saturday. <br />Chairperson Glassman opened the public hearing and asked for testimony from the public. <br />Elizabeth Proost, 7481 Washington stated that she was satisfied with the new canopy design, she <br />agreed with the proposed hours of operation and that she hoped that the gas deliveries would not <br />occur prior to 6:00 a.m. Carol Rossel, 7407 Teasdale stated that she is against the proposal, <br />approves the canopy design, is opposed to the proposed hours of operation, asked that the <br />business be closed on Sunday, wants assurance that conditions will be enforced and that special <br />attention is given to litter and noise control. Daniel Dugan, 7439 Washington stated that the <br />hours of operation are too long, does not want vending outdoor machines, is concerned about <br />litter and noise control and is concerned with enforcement of the conditional use permit. James <br />Marsh, 7461 Teasdale stated that he is concerned with traffic and noise. Susan Harper, 7457 <br />Teasdale stated that the building is too big for the lot, she is concerned with traffic on Hanley <br />backing up to Teasdale and that there is no need for a convenience store at this location. <br />Maureen Swihart, 7420 Teasdale stated she agrees with Susan Harper and is opposed to the <br />application because it is located within a residential neighborhood and will cause excessive <br />traffic and noise. <br />Mubeen Mahmood responded that he does not want to be closed on Sunday, does not want <br />outdoor vending machines, traffic will not be a problem, the height of the canopy will be 22 feet <br />and it will be a greenish-grey color. <br />Ms. Rossel stated that the majority of the people are opposed to the application and she is <br />concerned with the parking lot layout. Christopher Tau, 7439 Washington stated that he is <br />concerned with the lighting of the store.
