Ms. Harper stated that she does not feel the requirements for a conditional use have been met. No other members of the public indicated a desire to speak, so the public hearing portion of the meeting was closed. Mr. Credit stated that he feels the applicant has done a good job of working with the public and will vote for the proposal. Mr. Price stated that he is concerned with loitering and will vote for the proposal if it contains a condition concerning that. Ms. Glassman stated that a condition requiring only interior phones should be added. Ms. Arbogast stated that she approves of the new canopy design. Kay Drey, 515 West Point stated that she is opposed to the application and is specifically opposed to the hours of operation. The Plan Commission determined that the evidence presented to the Plan Commission does support the conclusion that the proposed conditional use amendment: a) Complies with all applicable provisions of the University City Zoning Code; b) At the specific location will contribute to and promote the community welfare or convenience; c) Will not cause substantial injury to the value of neighboring property; d) Is consistent with the Comprehensive Plan, neighborhood development plan (if applicable), and any other official planning and development policies of the City; and e) Will provide off-street parking and loading areas in accordance with the standards contained in Article 7 of the University City Zoning Code. Ms. Arbogast moved that the Plan Commission recommend approval of the Conditional Use Permit with the following conditions: 1.Signs on the premises shall conform in all respects with the provisions of the University City Sign Code. 2. The operator of the convenience store/gasoline station shall regularly police the site and the area adjacent to the store to remove litter and debris. 3. Trash containers for patron use shall be available on the premises at all times. Adequate refuse disposal shall be provided by and for the business. The refuse containers and surroundings shall be maintained in a clean condition. A detailed landscaping plan shall be submitted to the Director of Planning for review and 4. approval. Approval of the landscaping plan shall be contingent upon it being considered to demonstrate that screening is above and beyond the minimum screening requirements contained in Section 34-60 of the Zoning Code and that there is special landscape design K:\WPOFFICE\WPDATA\m-7-19-2000.plc.wpd
