January 24, 2001 Plan Commission Minutes Page 2 of 4 The applicants, Trey Miller, Linda Miller and Kenny Miller gave an overview of the proposal. They asked that the application be approved. Mr. Hill gave the staff recommendation that the application be approved per the January 19, 2001 Staff Memo. Chairperson Glassman opened the public hearing and asked for testimony from the public. Alan Rosenketter - 7208 Dorset, John Hustin - 7011 Tulane, Tom Kennedy - 7211 Dartmouth and Susan Crowe - 6764 Chamberlain all spoke in favor of the application. No other members of the public indicated a desire to speak and the public hearing portion of the meeting was closed. Mr. Munkel stated that he was in favor of the application. The Plan Commission determined that the evidence presented to the Plan Commission does support the conclusion that the proposed conditional use amendment: a) Complies with all applicable provisions of the University City Zoning Code; b) At the specific location will contribute to and promote the community welfare or convenience; c) Will not cause substantial injury to the value of neighboring property; d) Is consistent with the Comprehensive Plan, neighborhood development plan (if applicable), and any other official planning and development policies of the City; and e) Will provide off-street parking and loading areas in accordance with the standards contained in Article 7 of the University City Zoning Code. Mr. Smith moved that the Plan Commission recommend approval of the Conditional Use Permit with the following conditions: 1.In order to comply with parking requirements, towing operations shall not be permitted for the business nor any other uses that would require extra vehicles in their operations. 2.The rear area along the south side of the property shall have the paving removed and be used solely for a landscaped buffer area. 3.A detailed landscaping plan shall be submitted to the Director of Planning for review and approval, in conjunction with a review by the City Forester. Approval of the landscaping plan shall be contingent upon it being considered to demonstrate that screening is above and beyond the minimum screening requirements contained in Section 34-60 of the Zoning Code and that there are special landscape design and site planning features per Section 34-36.5(4) of the Zoning Code. Said landscaping shall be maintained in accordance with the approved plan. 4.All other conditions from Conditional Use permit #290 shall remain in effect and are incorporated into this permit by reference.
