January 24, 2001 Plan Commission Minutes Page 2 of 4 <br />The applicants, Trey Miller, Linda Miller and Kenny Miller gave an overview of the proposal. They <br />asked that the application be approved. <br />Mr. Hill gave the staff recommendation that the application be approved per the January 19, 2001 <br />Staff Memo. <br />Chairperson Glassman opened the public hearing and asked for testimony from the public. Alan <br />Rosenketter - 7208 Dorset, John Hustin - 7011 Tulane, Tom Kennedy - 7211 Dartmouth and Susan <br />Crowe - 6764 Chamberlain all spoke in favor of the application. No other members of the public <br />indicated a desire to speak and the public hearing portion of the meeting was closed. Mr. Munkel <br />stated that he was in favor of the application. <br />The Plan Commission determined that the evidence presented to the Plan Commission does support <br />the conclusion that the proposed conditional use amendment: a) Complies with all applicable <br />provisions of the University City Zoning Code; b) At the specific location will contribute to and <br />promote the community welfare or convenience; c) Will not cause substantial injury to the value of <br />neighboring property; d) Is consistent with the Comprehensive Plan, neighborhood development plan <br />(if applicable), and any other official planning and development policies of the City; and e) Will <br />provide off-street parking and loading areas in accordance with the standards contained in Article 7 of <br />the University City Zoning Code. Mr. Smith moved that the Plan Commission recommend approval <br />of the Conditional Use Permit with the following conditions: <br />1.In order to comply with parking requirements, towing operations shall not be permitted for the <br />business nor any other uses that would require extra vehicles in their operations. <br />2.The rear area along the south side of the property shall have the paving removed and be used <br />solely for a landscaped buffer area. <br />3.A detailed landscaping plan shall be submitted to the Director of Planning for review and <br />approval, in conjunction with a review by the City Forester. Approval of the landscaping plan <br />shall be contingent upon it being considered to demonstrate that screening is above and <br />beyond the minimum screening requirements contained in Section 34-60 of the Zoning Code <br />and that there are special landscape design and site planning features per Section 34-36.5(4) of <br />the Zoning Code. Said landscaping shall be maintained in accordance with the approved plan. <br />4.All other conditions from Conditional Use permit #290 shall remain in effect and are <br />incorporated into this permit by reference. <br />The motion was seconded by Mr. Credit and passed by a vote of 4 to 0, with all members voting <br />“aye.” <br />Hearing: Rezoning Map Amendment, SR to PA, 7023 Forsyth <br />K:\WPOFFICE\WPDATA\m-1-24.plc.wpd <br /> <br />
