May 23, 2001 Plan Commission Minutes Page 3 of 4 <br />The Plan Commission determined that the evidence presented to the Plan Commission does support <br />the conclusion that the proposed conditional use amendment: a) Complies with all applicable <br />provisions of the University City Zoning Code; b) At the specific location will contribute to and <br />promote the community welfare or convenience; c) Will not cause substantial injury to the value of <br />neighboring property; d) Is consistent with the Comprehensive Plan, neighborhood development plan <br />(if applicable), and any other official planning and development policies of the City; and e) Will <br />provide off-street parking and loading areas in accordance with the standards contained in Article 7 of <br />the University City Zoning Code. Mr. Smith moved that the Plan Commission recommend approval <br />of the Conditional Use Permit with the following conditions: <br />1.Signs on the premises shall conform in all respects with the provisions of the University City <br />Sign Code. <br />2. Trash containers for patron use shall be available on the premises at all times. Adequate <br />refuse disposal shall be provided by and for the business. The refuse containers and <br />surroundings shall be maintained in a clean condition. <br />3.A final detailed landscaping plan shall be submitted to the Director of Planning for review and <br />approval after consultation with the City Forester. Tree plantings for interior areas of the <br />parking lot shall consist of at least 50% canopy trees per Section 34-92.6(4)(c). Approval of <br />the landscaping plan shall be contingent upon it being considered to demonstrate that there is <br />special landscape design and site planning features per Section 34-36.5(4) of the Zoning <br />Code. Said features shall include special pedestrian facilities such as seating areas and <br />increased plantings along the street frontages. Said landscaping and site planning design shall <br />be maintained in accordance with the approved plan. Said plan shall be approved prior to <br />the issuance of a building permit. <br />4.A sight-proof fence or wall shall be established along all areas adjacent to residentially zoned <br />property (127' to the west and 38.86' to the southwest of the property). Said fence or wall <br />shall have a minimum height of six (6) feet but not more than eight (8) feet per Section 34- <br />60.2(1) of the Zoning Code. <br />5.Site coverage shall be increased to 75%. <br />6.Curb-cuts shall be approved by the proper state and/or county agencies. If there is a <br />substantial change in site design caused by those approvals, the applicant shall resubmit the <br />changes to the City Council. <br />7.Drainage and grading arrangements shall be approved by MSD and the City Public Works <br />Department. <br />8.A detailed construction traffic control and parking plan should be submitted to the Director of <br />Planning and Director of Public Works for approval.
