May 23, 2001 Plan Commission Minutes Page 3 of 5 <br />Zoning Code; b) At the specific location will contribute to and promote the community welfare or <br />convenience; c) Will not cause substantial injury to the value of neighboring property; d) Is <br />consistent with the Comprehensive Plan, neighborhood development plan (if applicable), and any <br />other official planning and development policies of the City; and e) Will provide off-street parking <br />and loading areas in accordance with the standards contained in Article 7 of the University City <br />Zoning Code. <br />Mr. Langton gave an overview of the proposal and asked that the application be approved. <br />Mr. Hill gave the staff recommendation that the application be approved per the September 20, 2001 <br />Staff Memo. <br />The Chairperson asked for comments from the members of the Public. Joan Botnowick, 511 <br />Westview Drive, stated that she did not want a package liquor store to go in there. Mr. Munkel stated <br />that the council would be extremely reluctant to approve a liquor license for that area. Mr. Hill stated <br />that package liquor stores are not a permitted nor a conditional use in that zoning district. Fred <br />Neiderman, 8063 Teasdale suggested that they make the egress along Old Bonhomme be right turn <br />only. No other members of the public wished to speak and the Public Hearing was closed. <br />The Plan Commission determined that the evidence presented to the Plan Commission does support <br />the conclusion that the proposed conditional use amendment: a) Complies with all applicable <br />provisions of the University City Zoning Code; b) At the specific location will contribute to and <br />promote the community welfare or convenience; c) Will not cause substantial injury to the value of <br />neighboring property; d) Is consistent with the Comprehensive Plan, neighborhood development plan <br />(if applicable), and any other official planning and development policies of the City; and e) Will <br />provide off-street parking and loading areas in accordance with the standards contained in Article 7 of <br />the University City Zoning Code. Ms. Arbogast moved that the Plan Commission recommend <br />approval of the Conditional Use Permit with the following conditions: <br />1.A final detailed landscaping plan shall be submitted to the Director of Planning and <br />Development for review and approval after consultation with the City Forester. Said <br />landscaping and site planning design shall be maintained in accordance with the approved <br />plan. Said plan shall be approved prior to the issuance of a building permit. <br />2.An eight foot high sight-proof fence or wall shall be established along all areas adjacent to <br />residentially zoned property per Section 34-60.2(1) of the Zoning Code. <br />3.Curb-cuts shall be approved by the proper state and/or county agencies.
