December 11, 2002 Plan Commission Minutes Page 2 of 3 <br />the specific location will contribute to and promote the community welfare or convenience; c) Will not <br />cause substantial injury to the value of neighboring property; d) Is consistent with the Comprehensive <br />Plan, neighborhood development plan (if applicable), and any other official planning and development <br />policies of the City; and e) Will provide off-street parking and loading areas in accordance with the <br />standards contained in Article 7 of the University City Zoning Code. <br />Mr. Zwolak spoke on behalf of the applicant and gave an overview of the proposal and asked that it be <br />approved. <br />Mr. Walker gave the staff recommendation that the application be approved per the November 7, 2002 <br />memo. <br />The Chairperson asked for comments from the members of the Public. No members of the public <br />wished to speak and the Public Hearing was closed. <br />The Plan Commission determined that the evidence presented to the Plan Commission does support <br />the conclusion that the proposed conditional use amendment: a) Complies with all applicable <br />provisions of the University City Zoning Code; b) At the specific location will contribute to and <br />promote the community welfare or convenience; c) Will not cause substantial injury to the value of <br />neighboring property; d) Is consistent with the Comprehensive Plan, neighborhood development plan <br />(if applicable), and any other official planning and development policies of the City; and e) Will <br />provide off-street parking and loading areas in accordance with the standards contained in Article 7 of <br />the University City Zoning Code. Mr. Smith moved that the Plan Commission recommend approval of <br />the Conditional Use Permit with the following conditions: <br />1.A final detailed landscaping plan shall be submitted to the Director of Planning and <br />Development for review and approval after consultation with the City Forester. Said plan shall <br />address the issue of tree trimming and/or removal of the trees in the front yard as mentioned in <br />the traffic study (concerning sight visibility at the egress area). Said landscaping shall be <br />maintained in accordance with the approved plan. Said plan shall be approved prior to the <br />issuance of the occupancy permit. Said landscaping shall be installed and finalized no later than <br />the following planting season after the end of construction. <br />2.The operator of the facility shall regularly police the site and the area adjacent to the building <br />to remove litter and debris. <br />3.Mechanical and electrical equipment shall screened per Section 34-60.3 of the University City <br />Zoning Code. Dumpster containers shall be screened per Section 34-60.4 of the University <br />City Zoning Code. <br />4.The child day care use approved under this permit shall be also approved and licensed by the <br />State of Missouri Department of Family Services.
