March 26, 2003 Plan Commission Minutes Page 2 of 4 <br />Mr. and Mrs. Muhammad gave an overview of the proposal and asked that it be approved. <br />Mr. Hill gave the staff recommendation that the application be approved per the March 11, 2003 <br />memo. <br />The Chairperson asked for comments from the members of the Public. Niambi Muhammad, 8326 <br />Delcrest spoke on behalf of the proposal. No other members of the public wished to speak and the <br />Public Hearing was closed. <br />The Plan Commission determined that the evidence presented to the Plan Commission does support the <br />conclusion that the proposed conditional use amendment: a) Complies with all applicable provisions of <br />the University City Zoning Code; b) At the specific location will contribute to and promote the <br />community welfare or convenience; c) Will not cause substantial injury to the value of neighboring <br />property; d) Is consistent with the Comprehensive Plan, neighborhood development plan (if <br />applicable), and any other official planning and development policies of the City; and e) Will provide <br />off-street parking and loading areas in accordance with the standards contained in Article 7 of the <br />University City Zoning Code. Mr. Smith moved that the Plan Commission recommend approval of the <br />Conditional Use Permit with the following conditions: <br />1.A final detailed landscaping plan shall be submitted to the Director of Planning and <br />Development for review and approval after consultation with the City Forester. Said <br />landscaping shall be maintained in accordance with the approved plan. Said plan shall be <br />approved prior to the issuance of the occupancy permit. Said landscaping shall be installed and <br />finalized no later than the following planting season after the end of construction. <br />2.The operator of the facility shall regularly police the site and the area adjacent to the building to <br />remove litter and debris. <br />3.The child daycare use approved under this permit shall be also approved and licensed by the <br />State of Missouri Department of Family Services. Occupancy shall be terminated by the City if <br />State approval or licensing is withdrawn for any reason. <br />4.Children shall be delivered into and picked up from inside the building by an adult parent or <br />guardian. <br />The motion was seconded by Mr. Kreishman and passed by a vote of 6 to 0 with all members voting <br />“aye.” <br />Hearing: Map Amendment / Rezoning, “LC” - Limited Commercial District to “SR” - Single <br />Family Residential District, 1513 North & South <br />Chairperson Arbogast announced that a hearing was scheduled to hear an application from the Meyer <br />Company, represented by Tim Allman, 14440 South Outer Forty, Chesterfield, MO 63017. The <br />applicant requests that the property at 1513 North & South be rezoned from “LC” - Limited <br />K:\WPOFFICE\WPDATA\m-3-26-2003.plc.final.wpd <br /> <br />
