Paul Goetzheimer, 7722 Cornell stated thathe was fine with the proposed conditions. No other members of the public wished to speak and the Public Hearing was closed. The Plan Commission determined that the evidence presented to the Plan Commission does support the conclusion that the proposed conditional use amendment: a) Complies with all applicable provisions of the University City Zoning Code; b) At the specific location will contribute to and promote the community welfare or convenience; c) Will not cause substantial injury to the value of neighboring property; d) Is consistent with the Comprehensive Plan, neighborhood development plan (if applicable), and any other official planning and development policies of the City; and e) Will provide off-street parking and loading areas in accordance with the standards contained in Article 7 of the University City Zoning Code. Mr. Irons moved that the Plan Commission recommend approval of the Conditional Use Permit with the following conditions: 1.Construction and development shall be in substantial conformance with the site plan, floor plans and elevations submitted with this application. 2.A final detailed landscaping plan shall be submitted to the Director of Planning and Development for review and approval after consultation with the City Forester. The plan shall comply with the requirements set forth in Section 34-60.2 of the Zoning Code Said landscaping and site planning design shall be maintained in accordance with the approved plan. Said plan shall be approved prior to the issuance of the building permit. Said plantings shall be installed and finalized no later following planting season after the end of construction. 3.Overnight outdoor parking of motor vehicles shall be prohibited except for those vehicles used in conjunction with the business. 4.With the exception of the storage of motor vehicles in accordance with Condition #3, all business, service, storage and display shall be conducted within the building. 5.Service and repair operations shall be limited to the hours between 8:00 a.m. and 7:00 p.m. Monday through Friday, between 8:00 a.m. and 5:00 p.m. on Saturday and between 11:00 a.m. and 4:00 p.m. Sunday. 6.The operator of the facility shall regularly police the site and the area adjacent to the business to remove litter and debris. 8. Trash containers for patron use shall be available on the premises at all times. Adequate refuse disposal shall be provided by and for the business. The refuse containers and surroundings shall be maintained in a clean condition. 9.Lighting of all exterior areas, including all parking areas, shall comply with the requirements of Section 34.93.7 of the Zoning Code, and shall be designed to be compatible with surrounding K:\WPOFFICE\WPDATA\m-5-28-2003.plc.wpd
