Paul Goetzheimer, 7722 Cornell <br />stated thathe was fine with the proposed conditions. No other members of the public wished to speak <br />and the Public Hearing was closed. <br />The Plan Commission determined that the evidence presented to the Plan Commission does support the <br />conclusion that the proposed conditional use amendment: a) Complies with all applicable provisions of <br />the University City Zoning Code; b) At the specific location will contribute to and promote the <br />community welfare or convenience; c) Will not cause substantial injury to the value of neighboring <br />property; d) Is consistent with the Comprehensive Plan, neighborhood development plan (if applicable), <br />and any other official planning and development policies of the City; and e) Will provide off-street <br />parking and loading areas in accordance with the standards contained in Article 7 of the University City <br />Zoning Code. Mr. Irons moved that the Plan Commission recommend approval of the Conditional Use <br />Permit with the following conditions: <br />1.Construction and development shall be in substantial conformance with the site plan, floor plans <br />and elevations submitted with this application. <br />2.A final detailed landscaping plan shall be submitted to the Director of Planning and Development <br />for review and approval after consultation with the City Forester. The plan shall comply with the <br />requirements set forth in Section 34-60.2 of the Zoning Code Said landscaping and site planning <br />design shall be maintained in accordance with the approved plan. Said plan shall be approved <br />prior to the issuance of the building permit. Said plantings shall be installed and finalized no later <br />following planting season after the end of construction. <br />3.Overnight outdoor parking of motor vehicles shall be prohibited except for those vehicles used in <br />conjunction with the business. <br />4.With the exception of the storage of motor vehicles in accordance with Condition #3, all <br />business, service, storage and display shall be conducted within the building. <br />5.Service and repair operations shall be limited to the hours between 8:00 a.m. and 7:00 p.m. <br />Monday through Friday, between 8:00 a.m. and 5:00 p.m. on Saturday and between 11:00 a.m. <br />and 4:00 p.m. Sunday. <br />6.The operator of the facility shall regularly police the site and the area adjacent to the business to <br />remove litter and debris. <br />8. Trash containers for patron use shall be available on the premises at all times. Adequate refuse <br />disposal shall be provided by and for the business. The refuse containers and surroundings shall <br />be maintained in a clean condition. <br />9.Lighting of all exterior areas, including all parking areas, shall comply with the requirements of <br />Section 34.93.7 of the Zoning Code, and shall be designed to be compatible with surrounding <br />K:\WPOFFICE\WPDATA\m-5-28-2003.plc.wpd <br /> <br />
