September 22, 2004 Plan Commission Minutes Page 2 of 4 <br />Mr. Smith moved that the Plan Commission recommend approval of the resubdivision / condominium. <br />The motion was seconded by Mr. Marentette and passed by a vote of 6 to 0 with all members voting “aye.” <br />Public Hearing: Conditional Use Permit, Packaged Liquor Store and Carryout Restaurant, <br />8510 Olive <br />The Chairperson announced that the public hearing was scheduled to hear an application from Mona <br />Moorehead, 4859 Cote Brilliante, St. Louis, MO 63113. The applicant requests that she be permitted <br />to operate a packaged liquor store and carryout restaurant at 8510 Olive. <br />The Chairperson noted the Commission's procedures and criteria for reviewing conditional use permits <br />and amendments to them. The Chairperson specifically stated that the Plan Commission must <br />consider whether the use: a) Complies with all applicable provisions of the University City Zoning <br />Code; b) At the specific location will contribute to and promote the community welfare or <br />convenience; c) Will not cause substantial injury to the value of neighboring property; d) Is consistent <br />with the Comprehensive Plan, neighborhood development plan (if applicable), and any other official <br />planning and development policies of the City; and e) Will provide off-street parking and loading areas <br />in accordance with the standards contained in Article 7 of the University City Zoning Code. <br />Verla Davis, 4859 Cote Brilliante, St. Louis, MO 63113 and Nate Grissom, 1159 Birch, University <br />City, MO 63130 represented the applicant and they gave an overview of the proposal and asked that it <br />be approved. <br />The Chairperson asked for comments from the members of the Public. Georgia Henderson, 8510 <br />Elmore asked questions concerning the location of the use. John Cyhaniuk, 8502 Olive asked that the <br />application be denied due to possible parking problems. He operates a butcher store nearby and does <br />not want a liquor store near his business. No other members of the public wished to speak and the <br />Public Hearing was closed. <br />Ms. Borg asked if the other businesses in the area had been contacted by the applicant. Mr. Grissom <br />stated that Ms. Moorehead stated she had contacted them. <br />Mr. Hill gave the staff recommendation that the application not be approved per the Staff Report. <br />The Plan Commission determined that the evidence presented to the Plan Commission does not <br />support the conclusion that the proposed conditional use amendment: a) Complies with all applicable <br />provisions of the University City Zoning Code; b) At the specific location will contribute to and <br />promote the community welfare or convenience; c) Will not cause substantial injury to the value of <br />neighboring property; d) Is consistent with the Comprehensive Plan, neighborhood development plan <br />(if applicable), and any other official planning and development policies of the City; and e) Will <br />provide off-street parking and loading areas in accordance with the standards contained in Article 7 of <br />the University City Zoning Code. Ms. Borg moved that the Plan Commission not recommend <br />approval of the Conditional Use Permit.
