September 22, 2004 Plan Commission Minutes Page 3 of 4 <br />Text Amendments of Section 34-40.7(3) concerning density requirements in the PD District and <br />Section 34-57.4(b) concerning common open space requirements in the PD District <br />The Chairperson announced that the hearing was scheduled to hear an application to amend Zoning <br />Code Section 34-40.7(3) concerning density requirements in the PD District and Section 34-57.4(b) <br />concerning common open space requirements in the PD District. The Chairperson noted the <br />Commission's procedures and criteria for reviewing text amendments. <br />Mr. Hill gave the staff recommendation that the application be approved per the Staff Report but as <br />modified by the alternative language submitted by Lynn Ricci in the memo titled “Alternative <br />bolded <br />Language for 34.40.07(3) as Submitted by Lynn Ricci, Plan Commissioner” as follows ( texts <br />are additions, stricken texts are deletions): <br />Section 34.40.07 Density and dimensional regulations and performance standards. <br />3.Planned Development-Residential (PD-R). <br />a.Density. The density of residential development shall be consistent with the <br />proposed type of(in other <br />intent of the original underlying residential district(s) <br />words if the proposed use is multi-family residential dwellings, density shall not <br />exceed the regulations of the “MR” - Multi-family Residential District); <br />. While <br />provided however, <br />the district regulations specifies upper limits to residential density, <br />that the <br />density of a planned development may be limited to that which is established <br />established in <br />in the original residential district or which is consistent and compatible <br />after due consideration of factors of <br />with nearby existing developed areas, <br />consistency and/or compatibility <br />. <br />T <br />Conversely, t he density limits indicated in the district regulations may be <br />exceeded on portions of the site within a “PD-R” district as long as the total site <br />density limit is not exceeded. This is referred to as “density transfer.” Additionally, <br />the total site density may be exceeded up to a limit, upon conclusion of the plan <br />commission and the council that the density bonus provisions contained in paragraph <br />“c” below have been satisfied. This is referred to as “density bonus.” <br />b.Calculation of Density. <br />(1)The computation of density shall be based on dwelling units per net acre for the <br />entire site. <br />(2)To compute the number of dwelling units per net acre, fifteen (15) percent of <br />the gross acreage of the parcel shall be deducted and the net acreage divided by the <br />lowest minimum lot size of the underlying residential district. <br />(3)In situation where a proposed “PD-R” district overlaps two or three residential <br />districts, density shall be calculated separately for the portions of the “PD-R” district in <br />each of the original residential districts. <br />K:\WPOFFICE\WPDATA\m-09-22-2004.final.plc.wpd <br /> <br />
