October 27, 2004 Plan Commission Minutes Page 7 of 9 <br />the Plan Commission must consider whether the use: a) Complies with all applicable provisions of <br />the University City Zoning Code; b) At the specific location will contribute to and promote the <br />community welfare or convenience; c) Will not cause substantial injury to the value of neighboring <br />property; d) Is consistent with the Comprehensive Plan, neighborhood development plan (if <br />applicable), and any other official planning and development policies of the City; and e) Will provide <br />off-street parking and loading areas in accordance with the standards contained in Article 7 of the <br />University City Zoning Code. <br /> <br />Ned Amos represented the applicant and gave an overview of the proposal and asked that it be <br />approved. <br /> <br />Mr. Hill gave the staff recommendation that the application be approved per the Staff Report. <br /> <br />The Vice Chairperson asked for comments from the members of the Public. Alan Rosenketter, 7208 <br />Dorset stated he was ambivalent about the application. Claudius Nunn, 7206 Dorset and Carol <br />Clooster, 7235 Dorset spoke against the proposal. Mark Donahoe, 7205 Dorset and Dennis <br />Sturdivant, 7249 Balson spoke in favor of the proposal (however Mr. Sturdivant stated he was not <br />against the development per se but had concerns about parking). No other members of the public <br />wished to speak and the Public Hearing was closed. <br /> <br />The Plan Commission determined that the evidence presented to the Plan Commission does support <br />the conclusion that the proposed conditonal use or amendment thereto: a) Complies with all <br />applicable provisions of the University City Zoning Code; b) At the specific location will contribute <br />to and promote the community welfare or convenience; c) Will not cause substantial injury to the <br />value of neighboring property; d) Is consistent with the Comprehensive Plan, neighborhood <br />development plan (if applicable), and any other official planning and development policies of the <br />City; and e) Will provide off-street parking and loading areas in accordance with the standards <br />contained in Article 7 of the University City Zoning Code. Ms. Ricci moved that the Plan <br />Commission recommend approval of the Conditional Use Permit with the following conditions: <br /> <br />1. Minimum lot size shall be reduced to below 2 acres as proposed in the application. <br /> <br /> <br />2.The standards for common open space shall be reduced to those as proposed in this <br />application. <br /> <br />3. The building and property shall be developed, constructed and maintained in compliance with <br />the plans submitted with the approved application. The height and mass shall be restricted to <br />that shown on the application plans. <br /> <br />4. A detailed landscaping plan shall be submitted to the Director of Planning for approval, in <br />conjunction with a review by the City Forester. The landscaping plan shall include a buffer of <br />large caliper trees along the south, west and east property lines to help screen the development <br />from abutting properties. Air conditioning units shall be screened with a dense evergreen <br />landscaping to create a buffer. Landscaping shall be installed and maintained in accordance <br />m-10-27-2004 plc final.doc <br /> <br />
