The motion was seconded by Mr. Smith and passed by a vote of 5 to 1, with Ms. Ricci, Mr. Smith, Ms. Arbogast, Mr. Myers and Mr. Marentette voting “aye” and Ms. Borg voting “nay.” Text Amendment: Zoning Code Section 34-104.2, Flags as signs The Chairperson announced that the hearing was scheduled to hear an application from the City for a text amendment to Section 34-104.2 concerning flags as signs. Mr. Hill gave an overview of the proposed text amendment. Ms. Ricci submitted some alternative language. Robert Gunther, owner of Fitz’s Restaurant gave an overview of his involvement with the text amendment. bolded Mr. Smith moved that the proposed text amendment be approved as follows (additions are and deletions are stricken through): 34-104.2 Permitted Signs 13. Flags of the United States of America, states, cities or other regional or national governmental flags. 14. Other Flags: a. Residential: 1. Types: i. Plain flags (of any color), and/or ii. Flags with non-commercial design elements including insignias, emblems, logos commonly used for decorative, seasonal, sports, or school identification purposes. 2. Limitations: i. This section applies only to occupants of a building with an approved occupancy permit, and further only to those that occupy the ground floor of the building with street frontage. ii. No off premises advertising shall be permitted as a flag under this section. b. Commercial: 1. Types: i.
