January 26, 2005 Plan Commission Minutes Page 2 of 14 <br />Ms. Ricci moved that action on the application be postponed until the Commission and Staff can <br />address specific issues with each other. The motion was seconded by Mr. Smith and passed by a vote <br />of 5 to 1, with Ms. Ricci, Mr. Smith, Ms. Arbogast, Mr. Myers and Mr. Marentette voting “aye” and <br />Ms. Borg voting “nay.” <br /> <br />Text Amendment: Zoning Code Section 34-104.2, Flags as signs <br /> <br /> <br />The Chairperson announced that the hearing was scheduled to hear an application from the City for a <br />text amendment to Section 34-104.2 concerning flags as signs. Mr. Hill gave an overview of the <br />proposed text amendment. Ms. Ricci submitted some alternative language. <br /> <br />Robert Gunther, owner of Fitz’s Restaurant gave an overview of his involvement with the text <br />amendment. <br /> <br />bolded <br />Mr. Smith moved that the proposed text amendment be approved as follows (additions are and <br />deletions are stricken through): <br /> <br /> <br />34-104.2 Permitted Signs <br /> <br />13. Flags of the United States of America, states, cities or other regional or <br />national governmental flags. <br /> <br />14. Other Flags: <br /> <br />a. Residential: <br /> 1. Types: <br /> i. Plain flags (of any color), and/or <br /> ii. Flags with non-commercial design elements including insignias, <br />emblems, logos commonly used for decorative, seasonal, sports, or <br />school identification purposes. <br /> 2. Limitations: <br />i. This section applies only to occupants of a building with an <br />approved occupancy permit, and further only to those that occupy <br />the ground floor of the building with street frontage. <br />ii. No off premises advertising shall be permitted as a flag under <br />this section. <br /> <br /> <br /> <br />b. Commercial: <br /> 1. Types: <br /> i. Plain flags (of any color) when displayed on commercial zoned <br />property, and/or <br />m-1-26-2005 plc final.doc <br /> <br />
