No other members <br />of the public wished to speak and the Public Hearing was closed. <br />The Plan Commission determined that the evidence presented supports the conclusion that the <br />proposed conditional use: a) Complies with all applicable provisions of chapter 34 of the University <br />City Zoning Code; b) At the specific location will contribute to and promote the community welfare or <br />convenience; c) Will not cause substantial injury to the value of neighboring property; d) Complies with <br />the overall neighborhood development plan and existing zoning district provisions; and e) Will provide, <br />if applicable, off-street parking and loading areas in accordance with the standards contained in the <br />University City Zoning Code. A motion was made by Ms. Borg that the Plan Commission recommend <br />approval of the application for a Conditional Use Permit subject to the following conditions: <br />a)The application shall be approved with an increased site coverage to 79%. To that end, the <br />applicant shall: install storm drainage detention facilities underground; design principal access to <br />the development tract at an approved location that allows for shared access by an adjacent <br />property; provide for screened loading and unloading areas; provide for mixed-use <br />developments that include community facilities that further the goals, objectives and policies of <br />the comprehensive plan; demonstrate use of innovative architectural, site planning and land use <br />design and of such quality as to set an excellent example for subsequent development or <br />redevelopment projects. <br />b)The application shall be approved with a decrease in parking requirements from 180 to 170 <br />spaces per Section 34-131.3(4)(b) of the Zoning Code. <br />The motion also included approval of the proposed preliminary development plan and recommended <br />that the City Council approve adoption of the following resolution: <br />RESOLUTION <br />WHEREAS, Section 34.40.14.2 of the University City Zoning Code requires that the <br />preliminary development plan be approved by the city council by adoption of a resolution approving <br />said preliminary development plan, with conditions as may be specified and authorizing the preparation <br />of the final development plan. Section 34.40.05 of the Zoning Code requires that the permitted land <br />uses and developments shall be established in the conditions of the ordinance adopted by the city <br />council governing the particular planned development-residential district. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />UNIVERSITY CITY, MO AS FOLLOWS: <br />The City Council hereby authorizes the preparation of the final development plan for the <br />proposal for this map amendment and resolution, to be known as “Addition to Olive <br />Farmer’s Market.” The specific uses of “all permitted uses and/or conditional uses as <br />K:\WPOFFICE\WPDATA\m-2-23-2005.plc.final.wpd <br /> <br />
