<br />November 8, 2006 Plan Commission Minutes <br /> <br />Page 2 of3 <br /> <br />welfare or convenience; c) Will not cause substantial injury to the value of neighboring property; d) Is <br />consistent with the Comprehensive Plan, neighborhood development plan (if applicable), and any other <br />official planning and development policies of the City; and e) Will provide off-street parking and <br />loading areas in accordance with the standards contained in Article 7 of the University City Zoning <br />Code. <br /> <br />The applicant gave an overview of the proposal and asked that it be approved. Mr. Hill gave the staff <br />recommendation that the application be approved per the Staff Report. The Chairperson Pro Tern <br />asked for comments from the members of the public. Richard Dockett, 6844 Crest stated that he <br />was representing the Roth Grove Neighborhood Association and is in favor of the proposal. Faye <br />Jordan, 6809 Vernon stated that she is concerned with food and trash in the area, the use of the <br />parking area and cleanliness. Eloise Garth, 680 1 Vernon stated she was concerned with noise, <br />people getting out of their car and urinating in the parking lot (as they do currently at this site). <br />No other members of the public wished to speak and the public hearing was closed. <br /> <br />The Plan Commission determined that the evidence presented to the Plan Commission does <br />support the conclusion that the proposed conditional use or amendment thereto: a) Complies with <br />all applicable provisions of the University City Zoning Code; b) At the specific location will <br />contribute to and promote the community welfare or convenience; c) Will not cause substantial <br />injury to the value of neighboring property; d) Is consistent with the Comprehensive Plan, <br />neighborhood development plan (if applicable), and any other official planning and development <br />policies of the City; and e) Will provide off-street parking and loading areas in accordance with the <br />standards contained in Article 7 of the University City Zoning Code. Ms. Borg moved that the <br />Plan Commission recommend approval of the Conditional Use Permit with the following <br />conditions: <br /> <br />1. Signs on the premises shall conform in all respects with the provisions of the University City <br />Sign Code. <br /> <br />2. The operator of the building shall regularly police the site and the area adjacent to it to remove <br />litter and debris. <br /> <br />3. Trash containers for patron use shall be available on the premises at all times. Adequate refuse <br />disposal shall be provided by and for the business. The refuse containers and surroundings shall <br />be maintained in a clean condition. <br /> <br />4. An eight foot high sight-proof fence shall be erected and maintained near the south property line <br />behind the building to the north of any proposed buffering and landscaping. The design, type <br />and color of fencing shall be subject to the approval of the Planning Staff. <br /> <br />5. A detailed landscaping plan shall be submitted to the Director of Planning for review and approval. <br />Approval of the landscaping plan shall be contingent upon it being considered to demonstrate that <br />screening is above and beyond the minimum screening requirements contained in Section 34-60 [per <br /> <br />Q:\ WPOFFICE\ WPDAT A \m-ll-08-2006.plc.final. wpd <br />
