<br />December 27, 2006 Plan Commission Minutes <br /> <br />Page 4 of 10 <br /> <br />Plat) for 1 McKnight Place, 3 McKnight Place, 8635, 8639, 8645, 8651, 8655, 8660, 8661, 8665, 8666, 8671 <br />8672, 8678 Barby Lane; 8655, 8660 8664, 8665, 8668, 8669, 8673 West Kingsbury and involving 8630 <br />Delmar and 8600 Delmar. The applicant requests authorization to permit: <br />1) the expansion of the apartments for the elderly (Gatesworth) by 38 units; <br />2) the expansion of the nursing home facility (McKnight Place Assisted Living) by 37 rooms; <br />3) the rezoning of the addresses on Barby Lane and West Kingsbury (listed above) from SR to HRO (except <br />8639 [north 67 feet of the lot] and 8645 [east 30 feet and north 67 feet of the lot] Barby Lane which is <br />requested to be rezoned from SR to GC); and <br />4) Preliminary Plat approval for lot consolidations, street vacations, street reconfiguration, replatting of <br />McKnight Place (between Delmar and Barby Lane) and request for temporary construction easement on 8630 <br />Delmar. <br /> <br />The Chairperson noted the Commission's procedures and criteria for reviewing conditional use permits and <br />amendments to them. The Chairperson specifically stated that the Plan Commission must consider whether <br />the use: a) Complies with all applicable provisions of the University City Zoning Code; b) At the specific <br />location will contribute to and promote the community welfare or convenience; c) Will not cause substantial <br />injury to the value of neighboring property; d) Is consistent with the Comprehensive Plan, neighborhood <br />development plan (if applicable), and any other official planning and development policies of the City; and <br />e) Will provide off-street parking and loading areas in accordance with the standards contained in Article 7 <br />of the University City Zoning Code. <br /> <br />The applicant gave an overview of the proposals and asked that they be approved as set forth in their <br />application presentation. Mr. Walker gave an overview of the Staff recommendation. Mr. Hill gave the staff <br />recommendation that the applications for conditional use permit amendments be approved with the conditions <br />set forth in the Staff Report. Staff further recommended that the applications for map amendment be <br />approved as presented with the exception of the properties located at 8668 West Kingsbury and 8678 Barby <br />Lane (which should remain SR). Staff further recommended that the Preliminary Plat application be approved <br />as submitted with the exclusion of the 8668 West Kingsbury (it should remain a separately platted lot as is) <br />and that the proposed cul-de-sac at the east end of West Kingsbury should be reconfigured to meet the <br />requirements of Section l6.l6.040(A) of the Subdivision Regulations of the Municipal Code. <br /> <br />The Chairperson asked for comments from the members of the public. Peter Winston - 8687 Barby Lane, <br />Jonathan Spetner - 8630 Delmar, Bob Kuhlman - 8670 West Kingsbury, Harris Frank - 1 McKnight Place, <br />Michael Peterson - 8655 West Kingsbury, Deborah Dunn - 8686 Barby Lane, Lynn Ricci - 7833 Gannon, <br />Bob Leonard - 1 McKnight Place and Lori Bells - 8672 West Kingsbury made comments on the proposal. <br />No other members of the public wished to speak and the public hearing was closed. <br /> <br />Conditional Use Permit Amendment for the 1 McKnight Place Expansion: The Plan Commission determined <br />that the evidence presented to the Plan Commission does support the conclusion that the proposed <br />conditional use or amendment thereto: a) Complies with all applicable provisions of the University City <br />Zoning Code; b) At the specific location will contribute to and promote the community welfare or <br />convenience; c) Will not cause substantial injury to the value of neighboring property; d) Is consistent with <br /> <br />Q:\ WPOFFICE\ WPDAT A \m-12-27-2006.plc.final. wpd <br />
