The properties located at 8645, 8651 and 8655 Barby Lane shall be permitted as single family <br />dwellings in the HRO zoning district under this conditional use permit. <br /> <br />7. Lighting of all exterior areas, including all parking areas, shall comply with the requirements of <br />Section 34.93.7 of the Zoning Code, and shall be designed to be compatible with surrounding <br />areas, shall be shaded to direct light downward and away from abutting uses. <br /> <br />8. All parking for the entire development, as it presently exists and the proposed additions, <br />including, without limitation, resident, guest, employee parking and parking for ancillary or <br />special events, shall be on-site and shall not be permitted on any adjoining or nearby public streets. <br />It shall be the obligation of the permittee to insure compliance with this requirement. <br /> <br />9. Drainage and grading arrangements shall be approved in writing by MSD and the City Public <br />Works Department and shall comply with the requirements of Title 16 of the Municipal Code. It <br />shall be the applicant's responsibility to submit the required approvals in a timely manner before <br />approval of the building permit. <br /> <br />10. Reconfiguration of any entrances onto Delmar shall be accompanied by the written approval by <br />the proper state and/or county agencies. If there is a substantial change in site design caused by <br />those approvals, the applicant shall resubmit the changes to department of planning development, <br />the plan commission and/or the city council (depending upon the effect of the changes required). <br />It shall be the applicant's responsibility to submit the required approvals in a timely manner before <br />approval of the building permit. <br /> <br />11. Tree removal and replacement shall comply with the regulations of Section 12-08 of the Tree and <br />Shrub Ordinance of the Municipal Code and shall be approved in writing by the City Forester. It <br />shall be the applicant's responsibility to submit the required approvals in a timely manner before <br />approval of the building permit. <br /> <br />12. A detailed landscaping plan shall be submitted to the Director of Planning for a coordinated <br />review with the City Forester and for the Director of Planning's approval. The plan shall exceed <br />the requirements of Section 34-60.2 of the University City Zoning Code and shall at least comply <br />with the provisions set forth with this application. The applicant shall demonstrate to the City <br />Forester and Director of Planning in said plan, prior to any excavation, that existing trees on <br />adjacent properties will not be damaged or destroyed by the construction of the retaining walls. If <br />any trees on adjacent properties are damaged or destroyed by the construction, the applicant shall <br />reimburse the owners of the properties effected for the fair market value of said trees. It shall be <br />the responsibility of the applicant to maintain all landscaping (including but not limited to the <br />landscaping on the proposed public rights-of-way). Timing of the installation of said landscaping <br />shall be at the earliest date possible.
