October 29, 2008 Plan Commission Minutes Page 2 of 3 <br />Dave Mastin, Architect, St. Louis Design Alliance, 6014 Delmar, St. Louis, MO 63112, gave an <br />overview of the proposal and asked that it be approved. Mr. Walker gave the staff <br />recommendation that application be approved per the Staff Report. The Chairperson asked for <br />comments from the members of the public. Joe Edwards, representing the Loop Special Business <br />Districts, 6504 Delmar spoke in favor of the proposal and reported that the board of directors <br />unanimously approved a motion in support of the project. No other members of the public <br />wished to speak and the public hearing was closed. <br /> <br />The Plan Commission determined that the evidence presented to the Plan Commission does <br />support the conclusion that the proposed conditional use or amendment thereto: a) Complies <br />with all applicable provisions of the University City Zoning Code; b) At the specific location <br />will contribute to and promote the community welfare or convenience; c) Will not cause <br />substantial injury to the value of neighboring property; d) Is consistent with the Comprehensive <br />Plan, neighborhood development plan (if applicable), and any other official planning and <br />development policies of the City; and e) Will provide off-street parking and loading areas in <br />accordance with the standards contained in Article 7 of the University City Zoning Code. Mr. <br />Senturia moved that the Plan Commission recommend approval of the Conditional Use Permit <br />with the following conditions: <br /> <br /> <br /> <br />1.The building and property shall be developed, constructed and maintained in compliance <br />with the plans submitted with the approved application. Color details for building faces <br />should be submitted to the Director of Community Development for review and approval. <br />It shall be the applicants responsibility to obtain those approvals in a timely manner prior <br />= <br />to issuance of the building permit. <br /> <br />2. A detailed landscaping plan shall be submitted to the Director of Community <br />Development for approval, in conjunction with a review by the City Forester. The <br />landscaping plan shall demonstrate creative ways to provide additional landscaping on <br />this limited lot. Landscaping shall be installed and maintained in accordance with the <br />approved plan. Said landscaping plan shall be finalized prior to issuance of the building <br />permit and shall be installed prior to issuance of any occupancy permits. It shall be the <br />applicants responsibility to obtain those approvals in a timely manner prior to issuance of <br />= <br />the building permit. <br /> <br />3. Lighting of all exterior areas, including the front parking area, shall comply with the <br />requirements of Section 34-93.7 of the Zoning Code, and shall be designed to be <br />compatible with surrounding areas by shading direct light downward and away from <br />abutting residential uses. <br /> <br />4. Drainage and grading arrangements shall be approved by MSD and the City Public <br />Works Department prior to issuance of a building permit by the Department of <br />Community Development.
