Session 1752
April 12, 1999

Responding to M~.'. Munkel, Mr. Ollendorrf was not completely sure if there would be a
change to tax revenue with this subdivision, but his guess would be that there would be no
loss, possibly a little more, since the units owned individually would have more value than
just one building ~nd with one owner.

Mr. Michael Thorn, attorney, 120 S. Central represents the owners of this building. Mr.
Thorn explained t'~at the four owners in the building are operating under a co-op, and will
be the same owners under a condominium. The building and the common ground become
owned by the condominium association.

Responding to Mr. Lieberman, Mr. Thorn said that nothing would be constructed or
changed in anyway with this subdivision.

Mr. Schoomer said that there is no defect in the application and therefore, the City Council
has no choice but to approve it.

The motion was carried unanimously.

AGENDA #4 - CONDITIONAL USE: DRIVE THRU PHARMACY AT HANLEY/OLIVE:

The Plan Commission and staff recommend denial of the request to permit a 24 hour
pharmacy drive th~'u instead of the current restricted hours of 7:00 a.m. to 11:00 p.m.
This issue present.,; a classic case of trying to be cooperative with a new business venture
promising good service to our citizens as against our strong commitment to protect
neighboring reside~ltial areas from damaging impacts. I suggest that the matter be tabled
or denied without prejudice to be reconsidered after 90 days experience with the limited
hours. While we should not approve the extended hours at this time, it may prove to be an
unnecessarily limit ng condition once we have had actual experience of a pharmacy only
drive thru.

Mr. Schoomer moved to table this issue. Mr. Munkel seconded the motion. All voted Aye,
except Mr. Wagner, who voted Nay.

AGENDA #5 - CONDITIONAL USE - 8301 DELCREST:

Mr. Ollendorff recommends approval of the Conditional Use Permit as approved by the Plan
Commission with a revised and expanded set of conditions. The proposed use is a luxury
apartment building with 219 units and many amenities. Conditions are as follows:

4
