Session 1092, 11inutes Page 3 <br />January 6, 1975 <br />forces thought it necessary, tlat Mr. Kling might be retained for assistance. <br />There was discussion, and Cit; 'Iaiiager Ilenry said that the system needs a more <br />qualified person now, even as to the revenue collection. <br />Councilman Lieberman expressed some concern about the flexibility of the <br />system and possible expansion or change, and he discussed this with Mr. Kling. <br />Councilman Weissenburger recommended that the Council authorize the City <br />Tlanager to move ahead with the acquisition of an experienced professional for <br />the data processing position and to withhold any decision on going with the <br />I14S or stand alone system. <br />After further discussion, Councilman Lieberman moved authorization for the <br />City Iianager to advertise and hire a data processing supervisor. lie also <br />asked that the compensation ordinance be amended accordingly. Ilotion was <br />seconded by Councilman Weissenburger, and unanimously carried. <br />PUBLIC HEARING - BILLS 130. 7033 Id -ID No. 7039, UTxrI3G TO ALCOHOLIC BEVERAGES: <br />(HOURS OF SALE AND II0U12S OF CLOSING) : <br />At 8:00 P.H., Itayor Kaufman announced that a public hearing scheduled for this <br />time is now open. Councilman Werner, who had requested that the bills be pre- <br />pared, and which had been given first reading at a previous meeting, explained <br />that the bills pertain to the closing of all establishments that sell liquor, <br />or non -intoxicating beverages, between the hours of 1:33 A.11. and 6:00 A.M. <br />every day of the week. In addition, he said, the bills have been set up so <br />that they conform to the current statutes of the State of Missouri. Ile dis- <br />cussed the effect of the bills, and said he would like it to be clear that <br />these bills would affect only establishments in this city that have licenses <br />for either liquor by the drink, or 3% beer licenses; a restaurant that serves <br />coffee, etc. only would not in any *ray be affected, but, if they do sell <br />liquor, they would have to close at 1:30 A.M. <br />In response to an inquiry by Councilman Lieberman, Councilman Werner said the <br />purpose of his introducing the two mills is to require closing of establish- <br />ments during certain hours, namely, between 1:30 A.I4. and 6:00 A.H. on any <br />day of the week, as a result of Judge 1,ichardson's ruling. He said that if <br />the bills are not adopted, taverns and establishments serving liquor could <br />stop serving liquor at 1:30 A.L. and continue to stay open for the purpose <br />of serving; food, and this would make it difficult to enforce the ordinance, <br />and for police to control. <br />Hr. Arthur Foger, attorney, representing the Pastrami Joynt, was the first <br />speaker. He reviewed the background history in detail, pointing out that at <br />the time the Pastrami Joynt first made application, they indicated the type <br />of business which they intended to open: that it would be primarily a food <br />establishment with 3.2 beer being served with the food, and they also indicat- <br />ed what hours they intended to stay open, which are from about 11 o'clock A.M. <br />to 3 o'clock A.11. the next morning, on a continuous basis. Ile said the <br />license was granted with the full understanding of the nature and the type <br />of operation which was proposed. He said his client is aware of the State <br />law which prohibits the sale of 3.2 beer after 1:30 A.! -'L. and there has been <br />no issue in that regard - they have abided by the law and sold 3.2 beer in <br />accordance with the hours provided by that law. <br />Continued, next page <br />
