Session 1092, 11inutes <br />January 6, 1975 <br />RECESS: <br />Mayor Kaufman announced <br />reconvened. <br />Page 4 <br />a recess at 8:301 P.II. and at 8:45 P.I:. the Council <br />Alcoholic Beverages, continued: <br />Mr. Poger was invited to continue his presentation. Discussing the litiga- <br />tion which had taken place, Iir. Poger explained what he understood to be <br />Judge Richardson's opinion in the injunction suit vs. the present ordinance <br />and his reference, in the opinion, to cutting down noise in front of the <br />Pastrami Joynt. l4r. Poger contended that the proposed ordinances set up <br />false standards for closing, and tie maintained that it we::ld be unfair for <br />any restaurants not selling drinks to be permitted to stay open 24 hours a <br />day. Ile quoted from Judge Richardson's opinion. Mr. Poger said that under <br />the economic conditions that exist today, it is imperative for his client to <br />stay open after 1:30 A.H. and he maintained that his client has the right to <br />stay open. lie stressed the fact that the Pastrami Joynt operators have done <br />nothing to violate either the laws of the State of Missouri or the laws of <br />the City of University City with regard to the application of the license. <br />Upon inquiry by Councilman Lerner whether Hr. Poger 'believes that the City <br />has the authority and the power to enact the proposed ordinances, Hr. Poger <br />replied that he is not certain about this because of cases in other states. <br />They debated the issue of closing hours by establishments serving intoxicating <br />liquor. <br />Mayor Kaufman asked whether ;ir. Poger has checked the practices of surrounding <br />communities in terns of closing hours of establishments comparable to that of <br />his client, and Iir. Poger said lie is not aware of any. <br />The following persons spoke in support of the Pastrami Joynt being permitted <br />to remain open after 1:30 A.I41. They felt, in the main, that it provides a <br />much needed service, offering a convenient, relaxing place to go to for good <br />food, after work, a show, etc. Further, that the City should do everything <br />possible to keep good, clean businesses in University City and should make <br />every attempt to encourage good development in this Community. <br />Dr. Helvin L. Goldman <br />8650 Barby Lane <br />Iir. James G. Lampe, 7579 Olive Street Road, owner of the <br />Arcade Lane :yowling Alley. Ile is opposed to the proposed <br />closing hours because it would result in putting him out <br />of business. Ile said he finds it necessary, quite frequently, <br />to remain open all night. ;le said he has a liquor license and <br />closes the bar in accordance with State law, but does keep his <br />place open at all hours to accommodate the bowlers. <br />Mr. C. Bidwell, 3112 Zoe Drive, Berkeley <br />Mr. Wilbert :line, 1112 Cantina, St. Louis County <br />At this juncture, Layer Kaufman stated that the Council has not made a judg- <br />ment on this matter; these are bills which have been introduced by a member <br />of this Council which will be evaluated very seriously after the public <br />hearing is concluded, and it is unlikely that a determination will be reached <br />this evening. <br />Continued, next page <br />
