Session 1241, Minutes Page 10 <br />March 24, 1980.. <br />City Attorney Kay said he has assumed that all the other municipalities are still <br />willing to make the appeal with University.City, since he has not heard anything <br />to the contrary. <br />Councilman Adams said he is not in favor of reimposing the tax, but feels the suit <br />should be appealed, since this issue should be local option --that is, decided by <br />the municipality and not the state legislature. <br />Councilman Sabol made a motion to drop the case, and Councilman Kelley seconded <br />the motion. There was discussion about whether or not Mr..Sabol could do this, <br />since he voted negatively when the originall decision was made to defend the case. <br />City Attorney Kay ruled it was necessary for someone who had voted affirmatively <br />on the original motion to bring it up for reconsideration. Councilman Kelley dis- <br />agreed, saying that every stage of litigation where you take an appeal is a sepa- <br />rate step and should be authorized separately by the Council. He felt that the <br />initial authorization to pursue this case does not automatically authorize any <br />number of appeals. <br />Mayor Mooney said that the Council would accept the opinion of Mr. Kay, as City <br />Attorney. <br />Councilman Sabol said he wo,ild like to have a second opinion from Mr. Kay about <br />this matter, before any further action in court is taken. <br />Ms Joyce Banaszak, 6926 Pershing, asked to address the Council. M5 Banaszak said <br />she and the group of which she is a part, the University City Citizens Against Un- <br />fair Taxation, are very much against the City's appealing this suit, and said she <br />hoped the Council would reconsider. Councilman Adams said that at least four mem- <br />bers of the Council were against the reimposition of the 1% sales tax, but that it <br />was a matter of whether or not the local municipality has the right to reimpose <br />the tax, as the state legislature so deemed, but which has not been collected be- <br />cause of the refusal of the utilities to do so. <br />ENERGY CONSERVATION <br />Councilman Sabol asked what measures are being taken by the City to conserve en- <br />ergy. Mayor Mooney said a program now in effect had been instituted by former <br />City Manager Ellman, and he asked Mr. Sabol to contact Mr. Ellman for full de- <br />tails. City Manager.0,1.enduiff aaid.he felt the City has an excellent program <br />under way in the area of energy conservation. <br />RETIREMENT OF COUNCILMAN GLICKERT <br />Mayor Mooney said that this was the last full council meeting for Councilman <br />Glickert, who has decided not to run for reelection. He.said she has been a <br />dedicated and loyal servant of the City for the last ten years, and that he hoped <br />the next ten years of her life will be her best. Councilman Glickert thanked the <br />mayor and said it had been a very broadening experience and that she had really <br />enjoyed it. <br />Councilman Sabol said he had enjoyed his association with Mrs. Glickert very much <br />and that he shared Mayor Mooney's observations. <br />
