The property is located in an "LC" Limited Commercial -.District and in accordance with Section 34-37.5 of the Zoning Code, the construction of a dwelling is permitted in this district only by Site Plan Review and the approval of the City Council. It is recommended that the site plan be approved as submitted with the following conditions: 1. Lots 2, 3, and 4 of Block 1 of Belmont Hills Subdivision shall be con- sidered as one parcel of land and shall not be hereafter subdivided. 2. No part_of_the premises shall be used for commercial purposes, and the owner agrees to the rezoning of the property to "SR" Single-family Residential should the Plan Commission and City Council, after review, find such a zoning change to be appropriate. Councilman Sabol moved approval. Councilman Glickert seconded the motion. Ms Johnson, now living at 1510 Lyndale, was questioned by Councilman Lieberman. He was concerned about the fact that the large number of children who live in the area have been using the three lots on which Ms Johnson is going to build as a route to the store, since there are no sidewalks in the area. Ms Johnson said there was an unpaved walkway next to the road, and :she is planning to have rail -- road ties built up next to that area so that people will walk on the walkway and not on her property. All voted Aye on the motion to approve. CONSIDERATION OF REQUEST FOR SOLICITATION PERMIT BY JUVENILE DIABETES FOUNDATION The City Manager said the City received a request from the Juvenile Diabetes Foun- dation to solicit funds on April 18, 19 and 20, 1980. This will be done only in front of.businesses where permission to do so has been granted. The funds will be used for diabetic research. Proper application forms have been filed, and permis- sion has already been granted by St. Louis and S-. Louis County for a planned met- ropolitan effort. Councilman. Adams moved app-rova.l,. with Councilman. Sabol seconding ..the motion. The motion carried unanimously. CONSIDERAT.I.ON -OF. IMPROVEMENT TO THE PERSHING-MIDVALE TRAFFIC. SIGNAL The City..Manager.said.the City received a request to -improve the signalization at the Pershing -Midvale intersection through -the installation.of.additional signal heads,.for .eas.tbound and westbound _traf.f.ic.., The cost. of the eastbound head would be $1,320 and for the westbound signal $850. These changes are not provided in the current budget and it will be necessary to transfer the required funds to the Engineering Division Account 42610-4 from the Contingency Account #6010. The requests for change at this intersection came from an individual request to the Traffic Commis.s.ion.and from Councilman Metcalfe. She said it should be han- dled by the staff rather than the Traffic Commission, since it is a matter of a change in design.
