Session 1234, Minutes Page 9 <br />December 17, 1979 <br />it will not collect the tax, if reinstated. That stand will probably be tested in <br />court, since University City and other municipalities have no way of collecting the <br />tax for themselves. <br />Mayor Mooney asked City Attorney Kay to read a letter which was to be sent to Mr. <br />Don Moschenross, Executive Director of the St. Louis County Municipal League, ask- <br />ing that the League act as a catalyst for the municipalities in St. Louis County <br />which desire to reimpose the city sales tax on residential utilities, which was au- <br />thorized by the Missouri legislature. <br />Councilman Metcalfe commented that if the sales tax is reimposed, she does not want <br />that revenue to go into the "pool" for distribution. Mr. Ellman said the cities who <br />reimpose the tax will get the money directly from the state, and it will not go into <br />the "pool." <br />Councilmen Adams, Kelley and Sabol all spoke against the bill, although Councilman <br />Adams added that he did not feel it was fair for the legislature to pass a bill half- <br />way through the budget year which eliminates a source of income for the City. <br />Councilman Lieberman said if the Council passes this bill, it does not mean they are <br />enacting a law suit --that would be decided at a later time, probably in conjunction <br />with other communities which are in the same position as University City. He felt <br />it was wrong for the state legislature to pass a bill eliminating the sales tax on <br />utilities, that it should not be within their jurisdiction, and the state does not <br />have a right to preempt the City's taxing prerogatives. He felt passing this bill <br />is just the first step --it does not mean the tax will be collected. <br />Councilman Glickert moved that this bill be adopted as an ordinance. Councilman <br />Lieberman seconded the motion. Upon roll call, the following vote was recorded: <br />AYES: Councilmen Glickert, Lieberman, Metcalfe and Mayor Mooney. NAYS: Council- <br />men Kelley, Sabol and Adams. The motion was carried by a vote of four to three, <br />and Bill No. 7392 became Ordinance No. 5204. <br />BILLS FOR INTRODUCTION <br />BILL 110. 7393 - AUTHORIZI4G THE CITY 14ANAGER TO EXECUTE AFFIDAVITS AS REQUIRED BY <br />LAW WITH REGARD TO USE AND APPLICATION BY VELE CITY OF THE COUNTY ROAD AND BRIDGE TAX <br />REFUND. <br />A bill was introduced by Councilman Sabol, entitled: <br />"AN ORDINANCE AUTHORIZING THE CITY 14ANAGER OF THE CITY OF UNIVERSITY CITY TO EXECUTE <br />SUCH AFFIDAVITS AS ARE REQUIRED BY LN,1 WITH REGARD TO THE USE AND APPLICATION BY THE <br />CITY OF THE COUNTY ROAD AI4D BRIDGE TAX REFUND." <br />The bill was assigned No. 7393 and given its first reading. <br />CONTINUATION OF DISCUSSION OF TUNNEL <br />Ms Maria Goodwin, 7042 Westmoreland, asked to address the Council concerning the <br />Millbrook tunnel, which was discussed at some length earlier in the meeting. Ms <br />Goodwin wanted to know what the next step would be in solving the problems with the <br />tunnel. Mayor Mooney asked Air. Ellman to respond.
