Mr. Ollendorff said that deliberately was not defined, <br />however, he suggested that nothing be done that would not be acceptable in a residential back yard (i.e., <br />no carnivals, yard sales, or other noise-producing activity). <br /> <br />Ms. Gloria Waters White, 545 Del Price Court, chair of Fortitude Foundation, an organization for <br />African-American college-educated women who perform public service, said there would not be any <br />activities that create loud noise. <br /> <br />Mr. Cotton noted that one condition states privacy fencing shall be installed; Mr. Ollendorff clarified that <br />along with the dense landscaping, the current fencing may be used if in good condition. The important <br />parameter is that the adjacent residential neighborhood.be protected, and the staff will determine that. <br />If the Foundation disagrees, it can come back to Council. <br /> <br />Mrs. Schuman said several University City non-profit groups were interested in finding out if the <br />Foundation was willing to rent its facility. Mrs. White said the Foundation does not yet have a full time <br />program and may eventually be willing to rent to those with a similar focus. <br /> <br />All voted Aye. <br /> <br />SITE PLAN - 6677 DELMAR. NIGHTCLUB, OFFICE BUILDING <br /> <br />The City Manager said approval was recommended for the site plan application to construct a new three- <br />story building at 6677 Delmar. The second and third floors will be used for office space, and the first <br />floor will have retail and a restaurant/nightclub facility. All of the uses comply with the City's zoning <br />ordinances, providing the following conditions are met: <br /> <br />1. The continued accessibility to available public parking is required to meet the parking requirements <br /> of the Code. <br />2. The front yard setback requirement is waived, but all other yards should be maintained in accor- <br /> dance with Zoning Code requirements. <br />3. There shall be no encroachments beyond the street lot line into the street right-of-way except as spe- <br /> cifically approved by the City in accordance with City ordinances. <br />4. The floor area ratio is approved on the basis of the lot area of both the Delmar and Kingsland lots. <br />5. The Delmar facade shall be revised to improve compatibility with surrounding properties and the <br /> final design shall be as approved by the City staff. <br />6. Materials and colors shall be reviewed and approved by the City staff. <br />7. Signs shall comply with the Zoning Code in all respects. <br />8. All exhaust equipment shall have odor and noise control. <br />9. Mechanical equipment shall be screened from view from the surrounding public property and resi- <br /> dences in the apartment building to the west. <br /> <br />Mr. Schoomer moved approval with all conditions, and Mr. Wagner seconded the motion. <br /> <br /> <br />
