Mr. Sorkin stated that there likely was not a liability with the reduced setback but it is more of an
aesthetic issue.

Mr. Greatens added that in the IC District, no property line setback is required. If a building is to
be setback, it shall be five feet. Once a building exceeds 35 feet, the setback is 15. The setback
increases from zero feet to 15 feet depending on whether or not it exceeds 35 feet in height.

Mr. Sorkin stated that this property is zoned industrial but is not like other industrial properties in
that it is adjacent to residential property.

Ms. Carr stated that the Plan Commission can only review the request for increased height and
reduced setback.

Ms. Lewis stated that based on the criteria set forth in the Zoning Code to approve a Conditional
Use Permit, it appears that the proposal meets those criteria.

Council.

Ms. Conoyer asked if the Parkview Gardens Plan addresses this property.

Mr. Lai stated that in the Plan, this area is reserved for the fire station.

Ms. Lewis asked for staff comments.

Mr. Greatens provided staff comments. The request is to exceed maximum building height and
reduce minimum building setback for the new fire station. The request is not related to the use
of property but to building height and setbacks. The maximum height proposed is 40.6 feet. The
proposed setback is five feet from the northern and western property lines.
that the proposed height and location is compatible with surrounding uses and will not have
detrimental impact on surrounding properties. Staff recommends approval with conditions in
Attachment B of staff report.

tion is for approval with conditions in Attachment B of the staff report.

Ms. Lewis asked the Plan Commission members for a motion.

Mr. Senturia added that based on the comments from the public, noise may be an issue for
neighbors. The fire depart response was that they would to try to avoid turning on sirens
until they are out of the neighborhood. Mr. Senturia stated he would like to include that
comment with the recommendation.

Ms. Felton made a motion to approve the Conditional Use Permit with conditions in Attachment
B of the Staff Report and that the fire department has stated their intent to try to avoid turning
sirens on until they are out of the neighborhood. The motion was seconded by Ms. Moran. The
motion passed unanimously.
tm; E
