Session 1698, Minutes <br />June 9, 1997 <br /> <br />Mr. Heberman asked if this project would be fully taxable. Mr. Deutsch replied in the affirmative. Mr. <br />Lieberman asked if there was some way that it would remain fully taxable. Mr. Deutsch responded that <br />if the IRS wanted to allow people to form tax exempt corporations, and purchase real estate, they could, <br />but this project is for profit. <br /> <br />Mr. Lieberman said that there was underground parking at the Gatesworth, and he realizes it was not a <br />nursing home originally, but there was insufficient parking. Mr. Lieberman asked the City Manager if <br />the standards in the zoning code were the same now as they were before - so many spaces per employees <br />and residents. Mr. Ollendorff answered in the affirmative and said that they have not changed their <br />standards. Mr. Heberman asked if their was some changes to this standard in the works because of the <br />problems created at the Gatesworth. Mr. Ollendorff replied that he was not sure what the new <br />proposed zoning ordinance stated about that. Mr. Heberman stated that he would like to avoid the <br />kinds of problems that were faced, in the past, with institutions like this. He realizes that the residents <br />do not have cars, but there are many employees and guests. Mr. Ollendorff replied that most of the <br />complaints for overflow parking, out in the neighborhood, came during periods of construction, when <br />you had not only the residents and the staff, but the construction workers for a new wing or addition. <br />He would not say that it was exclusively during those periods, but those times tended to be the worst. <br /> <br />Mr. Schoomer said, in comment to Mr. Lieberman's earlier question about tax exempt status, that there <br />was no way the City could control the tax exempt status of the facility. All that could be done would be <br />to rely on the proven integrity of Mr. Deutsch. <br /> <br />Mr. Lieberman asked the City Manager what criteria he was using to make the statement that the size <br />of the proposed project was too large for the site and should either be reduced in size or additional <br />property acquired. Mr. Ollendorff responded that the first general concern his staff had was that the <br />green area was too small and that the brown/asphalt area was too large. More green area would like to <br />be seen. This plan does meet the bare minimum of the City's zoning ordinance. Something better than <br />the minimum would like to be seen, which would mean adding more green wherever it could be added. <br />Mr. Ollendorff said that Mr. Deutsch explained that he could not get by with less parking, he could not <br />use underground parking because of expense reasons and that he could not make the building smaller or <br />acquire more property next door. <br /> <br />Mr. Schoomer asked if the courtyard space was considered part of the green space. Mr. Ollendorff <br />replied that it was not, in terms of fitting in with the surrounding neighborhood, because it could not be <br />seen. In a legal sense, certainly it is green space and it is available to the resident. It was also pointed <br />out by Mr, Deutsch, that while you look east at the large green yards, this property looks west to <br />postage stamp green space. <br /> <br />Mr. Munkel said that in the past when the City has had developments, such as apartments come before <br />Council, somewhere during the stage of development the neighbors find out about the project. They <br />sometimes get very upset. Mr. Munkel asked Mr. Deutsch if he had talked with his proposed neighbors <br />about the project, and if so, what was the result. Mr. Deutsch replied that he had not talked to anyone <br />about the project. <br /> <br />Mr. Schoomer would like to support Mr. Deutsch's plan, just to reward the support he has given the <br />community, but neither does he want to say to the City Manager and his staff that they are wrong, <br />because the plan is in accordance with City regulations.
