Session 1760 <br />June 21, 1999 <br /> <br />Conditional Use Permit shall become null and void with respect to the second and/or <br />third buildings unless a building permit is obtained for them within one year after <br />the substantial completion of the previously constructed building. <br /> <br />Mr. Wagner said that the Plan Commission had reviewed the first version of these plans in <br />April and recommended to Council to not approve the conditional use permit or the <br />rezoning required to do the project. The City Manager's statement to Council at that time <br />was that significant changes would be required. Since that time, the applicant has made <br />some changes in the design and he commends them for their response in attempting to <br />improve the design by reducing the sight line of the roof, thus the solar shading to the <br />residential properties to the east. He sees that they reduced the floor area ratio and <br />increased the setbacks somewhat and the building separation. However, the density, <br />which is his main concern, is still extremely high for this project, exceeding the 29 units <br />per acre of the Carleton Manor condominiums across the street. <br /> <br />Mr. Wagner moved that this new design be sent back to the Plan Commission to hear their <br />comments and wisdom on the extent to which the modifications have met their previous <br />objections. The motion died for lack of a second. <br /> <br />Mr. Munkel moved approval of the conditional use permit. Mr. Lieberman seconded the <br />motion. All voted Aye, except for Mr. Wagner, who voted Nay. The motion carried 6 to 1. <br /> <br />AGENDA #3 - PU~iLIC HEARING - REZONING 500-546 NORTH & SOUTH: <br /> <br />Mr. Ollendorff stated that 7:30 p.m. this date and place has been set to hear comments on <br />the proposed rezoning of property on the east side of North & South from our south city <br />limits north 600 feet to the end of the residential zone. The property would be reclassified <br />from Planned Development and Single Family Residential to High Density Residential. The <br />City Council has previously indicated that this zoning will not go forward until such time as <br />an acceptable conditional use plan has been approved. That action is recommended for <br />later on this agenda. Following consideration of comments at this public hearing and <br />consideration of the conditional use plan the next action that can be taken by the City <br />Council is to introduce a rezoning bill on the City Clerk's docket later this evening. Since an <br />excellent development plan has been received and the general nature of the project <br />conforms to the City's Comprehensive Plan, Mr. Ollendodf will be recommending approval <br />of such an ordinance at the appropriate time. <br /> <br />Mayor Adams opened the Public Hearing at 7:50 p.m. <br /> <br />John Paterson, 51] N.
