The Plan <br />shall be approved by the City Forester prior to the issuance of a building permit. <br />The contractor for the project shall be made a participant in the plan and shall <br />strictly adhere to the provisions of said plan. Every effort shall be taken (including <br />but not limited to those set forth in the Subdivision Regulations) to preserve the <br />trees designated to be saved under the plan. <br />The height and mass shall be restricted to that shown on the final approved <br />conditional use application plans. <br />A detailed construction traffic control and parking plan should be submitted to the <br />Director of Planning for approval. Said plan shall set forth details pertaining to <br />worker and resident parking during all phases of the proposed construction. It shall <br />further detail solutions to public property maintenance issues such as street cleaning <br />and traffic diversion. Said plan shall be finalized prior to the issuance of a building <br />permit. <br />Lighting of all exterior areas, including the front parking area, shall comply with the <br />requirements of Section 34-93.7 of the Zoning Code, and shall be designed to be <br />compatible with surrounding areas by shading to direct light downward and away <br />from abutting uses. <br />Drainage an,d grading arrangements shall be approved by MSD and the City Public <br />Works Department prior to issuance of a building permit. <br />The configuration of the guest parking along North & South is specifically approved <br />under the conditional use permit. <br />A traffic generation study shall be performed, at the applicant's expense, <br />demonstrating that the proposed use will not result in a significant increase in traffic <br />generation prior to issuance of the Conditional Use Permit. <br />Prior to development, the alley/walkway between North & South and Central shall be <br />vacated by the City. The City shall be compensated for the loss of the large tree as <br />determined I~y the City Forester. <br />The approval of the Conditional Use Permit is contingent upon the eventual approval <br />of a Resubdivision Final Plat consolidating the property to one lot. <br />The approval of the Conditional Use Permit is contingent upon the approval of <br />property being rezoned to "HR - High Density Residential District. <br />Retaining walls shall be provided along the western portions of the buildings to <br />increase the ground elevation thereby decreasing the appearance of the underground <br />parking story from being seen from the street. <br />The bay windows shall be permitted to project into the required yards as shown on <br />the submitted elevation drawings. <br />The developer shall be permitted to build the project in three phases per the <br />schedule listed on the Preliminary Plat Proposed Site Plan.
