Session 1764
August 30, 1999

AGENDA NO. 6 - METCALF PARK GRADING PERMIT:

Mr. Ollendorff recommended approval of a permit to allow Laceny Brothers'
contractor to grade along the north 30 feet of Metcalf Park in order to provide
proper slope and drainage conditions adjacent to their property line. This work is
necessary since the retaining wall along this property line was recently removed
due to settlement encompassing both properties. A condition of this permit is
that the City will be reimbursed for the trees which must be removed for the
project. Engineers for the City and Laceny Brothers agree that replacing the
retaining wall is not a viable option due to ongoing subsidence of the ground
underneath.

Mr. Munkel moved approval. Ms. Colquitt seconded the motion.

Responding to Mr. Lieberman, Mr. Ollendorff responded that he did not believe that this
work would interfere with Geo Technology's recommendation to excavate down to five
feet and then refill. It would probably make it easier. Laceny Brothers will reimburse us
for the trees that will have to be removed.

The motion passed unanimously.

ADD AGENDA ITEM:

Mr. Ollendorff asked to add another item to the agenda dealing with a picnic liquor
license for Loop In Motion.

Mr. Schoomer moved approval. Mr. Sharpe seconded the motion, which carried
unanimously.

AGENDA ITEM NO. 7 - LOOP IN MOTION PICNIC LIQUOR LICENSE:

Mr. Ollendorff stated this organization needed to receive their picnic license before they
applied for the state liquor license, so he respectfully requests approval of this
application.

Mr. Schoomer moved approval. Mr. Wagner seconded the motion.

Mr. Schoomer commented that this event had been held without difficulty for fourteen
years.

The motion passed unanimously.

6
