Session 1766 <br />October 4, 1999 <br /> <br />Of liquor sales to afternoon on Sunday. Mr. Schoomer had asked if we could differentiate <br />between restaurant/bars and package liquor stores and say that one or the other or both <br />could sell liquor at 11:00 a.m. The City Attorney has advised us that the City Council does <br />have the power to differentiate between these two groups. Council has a choice to allow all <br />liquor sales, be it restaurant or package liquor, to be sold at 11:00 a.m. or Council can just <br />allow restaurants to sell liquor at 11:00 a.m. and not package stores. <br /> <br />Mr. Wagner said that he would like to introduce the bill that allows only restaurants to sell <br />liquor at 11:00 a.m. <br /> <br />Mr. Munkel said that he would like to introduce the bill that allows only restaurants to sell <br />liquor at 11:00 a.m, <br /> <br />Mr. Schoomer stated that what we are talking about represents about 104 hours of <br />operation in a year. The businesses fee) that they are now being placed at a competitive <br />disadvantage with neighboring municipalities that do permit liquor sales at 11:00 a.m. on <br />Sunday. He is inclined toward the more liberal interpretation to allow all, restaurants and <br />package stores, to open at 11:00 a.m. <br /> <br />Mr. Wagner said that he believes that the restaurants are in a much more competitive <br />market than the stores and he is more than willing to open it up only to restaurants. <br /> <br />Ms. Colquitt agrees with Mr. Wagner, noting that the Loop restaurant/bars are attempting <br />to stay in competition with Clayton and the Central West End. <br /> <br />Mr. Lieberman also agrees with Mr. Wagner and Ms. Colquitt. <br /> <br />Mr. Sharpe said that he is favor of the liberal interpretation allowing all to open at 11:00 <br /> <br />The sense of Council was to introduce the more restrictive bill allowing only restaurants to <br />open at 11:00 a.m. on Sundays. <br /> <br />A bill was introduced by Mr. Wagner, Mr. Munkel, Ms. Colquitt and Mr. Lieberman, <br />entitled: <br /> <br />AN ORDINANCE AMENDING CHAPTER 5.08 OF THE MUNICIPAL CODE, <br />RELATING TO ALCOHOLIC BEVERAGES, BY REPEALING SECTION 5.08.240 <br />THEREOF, RELATING TO HOURS OF SALE AND CLOSING - SALE ON <br />SUNDAY, AND ENACTING IN LIEU THEREOF A NEW SECTION TO BE <br />KNOWN AS "SECTION 5.08.240 HOURS OF SALE AND CLOSING - SALE OF <br /> <br />8 <br /> <br /> <br />
