Session 1769
November 8, 1999

Mr. Ollendorff asked the Mayor to ask a developer in the audience to come forward to
answer the question.

Mike Samitz, 520 North & South, a developer for Paul Londe, said that a 3D model could
cost a developer $10 - $12,000. AutoCad software produces similar studies which is
absolutely accurate. This program is widely used by architects and developers across the
country. Grade changes and dimensions of the buildings has to be taken into account,
also.

Mr. Munkel wished to know what the Plan Commission's purpose was to require these
models. Mr. Ollendorff said that it gives the Plan Commission members a better idea of
what the project will look like over a flat blueprint site plan. Mr. Munkel does not believes
there is any reason to amend the zoning code with this requirement. He believes as long
as the Council has the authority to request one as a condition in a conditional use permit,
in certain cases, then he does not believe it is necessary.

Mr. Munkel moved not to have a public hearing dealing with an amendment to require 3D
models. Ms. Colquitt seconded the motion, which carried unanimously.

The Council instructed Mr. Ollendorff to report to the Plan Commission that the Council will
request 3D models in specific cases, but that the Council was not interested in amending
the zoning ordinance. Mr. Lieberman clarified that the Plan Commission would have the
power to recommend that 3D models be required, as well.

AGENDA #7 - FINAL PLAT FOR 7805-07 DELMAR CONDOMINIUM:

Mr. Ollendorff agrees with the Plan Commission that approval should be granted on the
final plat for resubdivision into two condominiums for the building at 7805-07 Delmar. All
ordinance requirements have been met.

Mr. Schoomer moved approval. Mr. Sharpe seconded the motion.

The Mayor asked that the proprietor of the plat come forward to answer questions of the
Council.

Responding to Mr. Lieberman, Kent Evans, 7807 Delmar, responded that he was the only
resident of the building and the owner and therefore, he approves it.

The motion to approve carried unanimously.

AGENDA #8 - CONDITIONAL USE FOR SALES OFFICE - 530 NORTH & SOUTH:
