Mayor Welsch suggested that Council allow anyone interested in being appointed to <br />the two new commissions be given an opportunity to do so and Council look at <br />making the necessary changes to Rule Number 39. <br /> <br />Mr. Sharpe concurred with the Mayor’s suggestion. <br /> <br />Mayor Welsch also suggested that Council review and make necessary changes to <br />the rule pertaining to an individual’s ability to serve on two commissions. She stated <br />that although there is a need to keep the IDA Commission in place, there are <br />members of that commission who have expressed an interest in being involved <br />elsewhere, but are prohibited from doing so, even though the commission has not <br />met for more than 12 years. <br /> <br />Mayor Welsch noted that there seemed to be a consensus that if Council has a <br />member from another commission looking to rather be on different commission, <br />that they be able to step down from a current commission and the new appointment <br />would be looked upon favorably. She stated that there also had been a consensus <br />for Council to review the applicable rules at a later date. <br /> <br />G. SWEARING IN <br />1. <br />Tom Sontag was sworn in to the Urban Forestry Commission in the City Clerk’s <br />office. <br />2. <br />Esley Hamilton was sworn in to the Historic Preservation Commission in the City <br />Clerk’s office. <br /> <br />H. CITIZEN PARTICIPATION (Total of 15 minutes allowed) <br />Jan Adams, 7150 Cambridge <br />Ms. Adams stated that the legal opinion provided by a Councilmember at the October <br />th <br />14 Council meeting related to the issue of adverse possession if the City sweeps <br />private streets or provides bicycle lanes on private streets where the trustees of the <br />private streets grant permission to the City to perform these services was not valid. <br />She stated that if the City is granted permission it is considered to be a grant of a <br />license. And where a license has been granted the essential element for an adverse <br />possession is negated. Ms. Adams stated that she believed Council should adopt a <br />rule that requires any member of Council who purports to offer citizens a legal opinion, <br />be required to submit that opinion in writing and signed by a lawyer. She stated that it <br />is a blatant misrepresentation to suggest that the City is exposing taxpayers to lawsuits <br />for money damages where there is no legal basis for such threats. She concluded that <br />such behavior constitutes malfeasants of office and should not be tolerated. <br /> <br />I. PUBLIC HEARINGS <br /> <br /> <br />J. CONSENT AGENDA <br /> <br />K.
