He noted that the tenant <br />was considering a five-year l~-~e with two five-year options, so it would be <br />a long-term situation. <br /> <br />In response to Mr. Wagner, Mr. Shapiro said the 18 spaces would be for custo- <br />mer parking only, as requested by the potential tenant. <br /> <br />Mr. Schocmer asked Mr. Best to c~uLent on responses he received frc~ adjacent <br />businesses regarding t_ha additional spaces. Mr. Best said he could not reach <br />Market in the Loop owner Din1 Wald, who was out of the country, but the others <br />had no objection. Mr. Shapiro said the building will be lit during evening <br />hours when the business is open, which should provide additional security. <br /> <br />In response to Mr. Ollendorff, Mr. Shapiro said he did not believe granting <br />this request would lead to similar denands frce other businesses. Mr. Ollen- <br />dorff asked whether he would be allowed to visit another business in the Loop <br />if he parked in a marked space. Mr. Shapiro said he did not believe the ten- <br />ant would strictly enforce the dedicated parking. ~he City Manager suggested <br />Eking the parking, but with no time limit. Heyor Majerus said the City was <br />trying to work out a cc~pL~,.~se so that adjoining businesses would not be <br />penalized. Mr. Best said the tenant was concerned about parking since there <br />was so little in front of the building; however, he thought they might not <br />object to eliminating the time limit. <br /> <br />Mr. Schoceer said the proposal clarifies what was previously a chaotic situa- <br />tion. He moved approval, with Mr. ~a~ms seconding the motion. <br /> <br />Mayor Majerus was concerned that the ~ would be effective into perpe- <br />tuity, and suggested it be reviewed or renewed on an annual besis or with a <br />change in tenants. Mr. Shapiro asked if it could be tied to the renewal date <br />on the l~e. Mr. Wagner thouc~ht it should be sooner. Mr. Schoomer reminded <br />Council that the space is currently reserved for building tenants during the <br />day, however, Mayor Majerus said the amendment would make it exclusive to the <br />building during the tenant's hours of operation. Mr. Shapiro said they were <br />requesting the hcurs of 9 a.m. to midnight. Mayor Majerus said in the future <br />there might need to he some modification because of additional development or <br />other changes, and without review that option would be prohibited. <br /> <br />Mr. Best said nine of the requested additional spaces do not currently exist, <br />end the developer is incurring the expense of improving the area because of <br />the prospective tenant. He did not feel the tenant's request was excessive, <br />noting they will bring a great deal of positive street traffic to the Loop. <br />Mr. Shapiro said permission to create tb~ spaces has been obtained; all that <br />is being asked for is a change in the easement regarding hours. <br /> <br />Mr. Schocmer suggested a review at the end of the first year, then a review <br />at the time of lease renewal thereafter. Mr. Best said the tenant ~m/st be <br />able to feel the 18 spaces will not be taken away after a year.
